Fired Cox employees ask judge to allow lawsuit to proceed

Two CoxHealth dialysis supervisors, who were fired by the hospital, are asking a federal judge to allow their lawsuit to continue.

Plaintiffs Roger Cochran and Dennis Morris feel they have fulfilled their obligation not to interfere with an ongoing, overlapping federal investigation of CoxHealth, and should be allowed to resume their case, according to the motion, filed in U.S. District Court in Kansas City.

The federal government has been investigating possible Medicare fraud by Cox.

The investigation and lawsuit were first revealed in the June 8, 2005, Turner Report.
