Court accepts defendant's guilty plea finding that he understands the nature of the charges against him and the consequences of entering a plea of guilty to the charges. The court finds that there is a factual basis for the plea of guilty, that the defendant's plea of guilty is made freely and voluntarily and with an understanding of defendant's rights. The court accepts the Defendant's guilty plea and finds the Defendant guilty beyond a reasonable doubt. Exhibits 1 and 2, petition to enter a guilty plea and the plea agreement, are admitted into evidence, and accepted into the court's file. State dismisses Count 3, per plea agreement. Sentencing Assessment Report was waived by agreement of the parties. The court proceeds to sentencing. Allocution is granted. No legal cause or reason having been shown why sentence and judgment of the Court should not be pronounced. It is the sentence and judgment of this Court that Defendant be sentenced to Seven (7) years in the MO Department of Corrections. Said sentence is to be run concurrently with any other sentences. The court Suspends Execution of the Sentence and Defendant is placed on Five (5) years of Supervised Probation with the MO Board of Probation and Parole. Court Costs, including any lab fees, are assessed against the Defendant. Court conducts examination under Rule 24.035. The defendant having appeared at the conclusion of final sentencing, having been advised of the right to proceed under Rule 24.035, and having been examined by the Court on the record as to the assistance of counsel received by defendant, and the Court being fully advised in the premises, the Court now finds that no probable cause exists for a finding of ineffective assistance of counsel.
