A South Carolina company filed a breach of contract lawsuit against O'Sullivan Industries Wednesday in U. S. District Court for the Western District of Missouri.
Out of Sight Litter Box, Inc., claims O'Sullivan officials entered into a licensing agreement with the company on May 1, 2006, giving O'Sullivan "the exclusive
right and license to use Plaintiff’s Existing Patent to make, have made, distribute, market, and sell throughout North America, Belgium, France, Germany, Ireland, the Netherlands, and the United Kingdom (the “Territory”) products that incorporated the inventions disclosed in Plaintiff’s Existing Patent."
According to the contract:
"Defendants were to pay Plaintiff at least certain minimum royalties, to wit: for the Contract Year ending April 30, 2007, $50,000.00, for the Contract Year ending April 30, 2008, $150,000.00, for the Contract Year ending April 30, 2009 and every Contract Year thereafter, $300,000.00. (as applicable, the Minimum Royalty or Minimum Royalties)."
The lawsuit says O'Sullivan Industries failed to make, license, or distribute any of its products, and failed to pay the minimum quarterly royalty fees.
Out of Sight Litter Box is asking for actual damages and punitive damages and is requesting a jury trial.

ReplyDeleteWell that is NOT suprising. that sounds just like the big dogs at Osullivans. They are ALWAYS wanting something for nothing. And do not care who they screw over to get what they want. Including us employees. They have lied to us far to many times. When the plant manager turns in his notice while they are shut down due to lack of no money then that should tell everybody something. Time to get away from there and find a better place to work. Before they tell us to go find something else. And that is certainly coming. They are just playing games with us to see how many will be suckered into no work with no pay for god only knows how long. Then when we go back, then how many days till no money again????

ReplyDeleteHard to get blood out of a turnip, I'm not sure how the Kitty box people will receive anything. Maybe they can sell the patent to the next sucker.
I sure did get some enjoyment over the applause about the resignation of Kelly Terry. Another Atlantean bit the dust, or just plain bailed out.
It's just so sad that the company is being sued after all they've been through.

There done laying off 80% this fri and shutting the doors and locking them up come July. Get out while you can they are going to wait till Fri to tell everyone. Shipping personel have already been told this by there supervisor.
ReplyDeleteHey if you like working lots of overtime and getting your butt rode and some harassment here and there then you could always go apply at La-Z-Boy in Neosho. They are always hiring because they can't keep many to stay. Or you could just draw your umemployment for awhile because no telling how long until La-Z-Boy moves their plant ot China.
