Scheduling order to be filed in Cox lawsuit

Now that a stay preventing discovery from taking place has been lifted, both sides in the wrongful dismissal lawsuit filed by two former CoxHealth employees have 15 days to file a scheduling order, according to an order from Judge Gary Fenner filed today in U. S. District Court for the Western District of Missouri.

The stay on the discovery process will be lifted as of July 11, according to an earlier Fenner ruling. Roger Cochran and Dennis Morris claim they were fired from their positions at Cox because they had uncovered fraud in Medicare and Medicaid reimbursement. The government asked for the stay in the civil suit while the case was being investigated by a federal grand jury.

The lawsuit and the grand jury investigation were first revealed in the June 8, 2005, Turner Report.
