Judge rules for Avilla School District in disability lawsuit

U. S. District Court Judge John T. Maugher issued a summary judgment in favor of the Avilla R-13 School District today, ending a disabilities lawsuit filed in November 2009.

In his ruling, Maugher said Tom and Faye Williams had not "exhausted their administrative remedies under IDEA (Individual with Disabilities Act).

Tom and Faye Williams had claimed the school district failed to provide help for their 14-year-old child, who has been diagnosed with ADHD.
They claimed the district failed to determine his eligibility for services, failed to evaluate his need for occupational therapy and failed to provide the family with a notice of the boy's rights.

They had asked for damages, attorneys' fees, and "compensatory education accommodations."
