Fifth judge assigned to Jalen Vaden murder trial after Nicholas recuses

A fifth judge has been assigned to the Jalen Vaden murder trial and it appears inevitable that there will be sixth.

Judge John Nicholas recused this morning, leaving only one other active judge, Stephen Carlton, eligible in Jasper County Circuit Court, and Carlton is scheduled to retire at the end of the year, which would indicate he will follow the same path taken by judges David Mouton, Gayle Crane and Nicholas and remove himself from the case.

Vaden's attorney, Tracey Martin, filed a motion asking the first judge assigned to the case, Dean Dankelson, to recuse himself because he was a friend of the victim's grandfather, attorney Judd McPherson. Dankelson refused, forcing Martin to use the one removal she is allowed under Missouri law.

After that, the case will be assigned to an out-of-county judge. The trial will be held in Jasper County.





The scheduled April 2019 trial date has been stricken.

Vaden, 23, Carl Junction, is charged with second degree murder and felony child abuse in connection with the December 1, 2017 death of Jayda Kyle.

The child died at Children's Mercy Hospital in Kansas City three days after she was hospitalized due to abuse that took place at her home at 405 Meadow Lake, Carl Junction. Vaden was the live-in boyfriend of Jayda Kyle's mother, Devyn Kyle.

My counting is all right. My editing on this one left something to be desired. While I was working on the post, I removed a paragraph noting that Vaden's attorney, Tracey Martin, used the change of judge she is allowed under state law to remove the first judge assigned to this case, Dean Dankelson. I have edited the story to add that information. Thanks for catching that. Stephen Carlton is the fifth judge.
