Mmm, mmm, bad! Christian County woman sues Walmart after cashier knocks off can of soup, injures her foot


A Christian County woman who claims a cashier injured her foot when she knocked a "large, heavy can of soup" off the counter at the Branson West Walmart is suing.

In the lawsuit, which was originally filed in Stone County Circuit Court and was transferred to federal court today, Shelley Bryant claims "Jane Doe," the cashier who was handling her items on October 27, 2016, "failed to follow Walmart's safety policies regarding the scanning and bagging of items on or about the checkout counter" and the woman "carelessly, and without warning, knocked the heavy can of soup off of the counter and directly onto plaintiff's foot."







The petition does not indicate if everything would have been all right if the cashier had warned Bryant before she knocked the can of soup off and hit Bryant's foot, or if Walmart's safety policies specifically direct employees to avoid sending soup in the direction of their customers.

The lawsuit claims Walmart should have safety "baricades" (sic) in place at the check out counter and no warning signs to tell customers that there are no barricades (as there should be in places where a customer might come into contact with large, heavy cans of soup flying off the counter).

According to the lawsuit, the "large, heavy can of soup" caused the following:

-Injury to her right foot

-Compartmentalized Regional Pain Syndrome

-Expenses for future medical care and treatment

-Emotional upset, anxiety, pain and suffering

The lawsuit, which was filed by attorney Tom A. Kapstrom of Springfield Injury Law, asks for "damages as are fair and reasonable," and costs.

Bryant is asking for a jury trial.

    The cans of soup need to have warning labels attached for safety. WARNING!!! DO NOT DROP CAN OR HOT SOUP ON BODY PARTS OR EAT SOUP WHILE DRIVING UNDER THE INFLUENCE.
