A Joplin woman filed a lawsuit today against G&W Foods, owner of the Cash Saver store at 811 W. 7th after slipping in a puddle of standing water in an aisle August 19, 2021.
Dianna Turner (DOB 1960), represented by attorney Patrick Martucci of the Joplin firm of Johnson, Vorhees and Martucci, says her injuries were a direct result of G&W's negligence.
B. by not maintaining its air conditioning unit in good working order so as to allow it to leak water and drip onto the floor where members of the public are known to traverse;
C. by not performing proper, frequent, and adequate inspections of the premises to discover fall hazards;
D. by not timely remedying the water hazard on the floor;
E. by not warning customers about the water hazard on the floor; and
F. by not erecting barricades, signs, cones, caution tape, or other devices to alert customers to the presence of water on the floor and the need to avoid the area;
The petition claims the company's negligence caused Turner injuries to her buttocks, back, left arm and neck, as well as pain, suffering, anguish and medical and pharmaceutical expenses.
The lawsuit asks for fair and reasonable damages and costs.
