In a lawsuit filed Wednesday in Jasper County Circuit Court, a former Lamar student claimed Freeman Health System shared Protected Health Information (PHI) about her mental health treatment.
The plaintiff, whose name is listed as C. J. in court documents, also claims the hospital did not protect her personally identifiable information (PII), leaving her open to invasion of privacy and identity theft.
According to the petition, a unit secretary who knew the girl, but was not associated with the case, examined the file and then passed along information to her daughter, who attended the same school and the details of her hospital stay to began to spread.
A parent who heard the news told C. J.'s mother.
These disclosures resulted in significant public and private humiliation and have damaged Plaintiff’s reputation at work and in the community. After the disclosure, Plaintiff refused to leave her home unless forced to by her mother. Plaintiff was so distraught she has since moved away from Lamar as a result of the disclosure of her medical information.
The six-count lawsuit accuses Freeman of breach of implied contract, negligence, breach of fiduciary duty of confidentiality, violations of Missouri Merchandising Practices Act, negligent training and supervision and negligence per se.
C. J. is asking for damages, an order preventing Freeman from "continuing to engage in the unlawful business practices alleged herein," and attorney fees.
C. J., who is represented by Lucy McShane of the Overland Park firm McShane & Brady LLC, is asking for a jury trial.
This sort of activity happens every day in local businesses and companies. A couple of these cases might encourage better employee training. Poor child.

ReplyDeleteI hope she sues them right out of business. That place is a dump and it needs to go. I've been in there as a patient and in the ER. That place is so missed managed it's like a three-ring circus not to mention all the cockroaches crawling around on the floors that I saw and all the filth from lack of proper cleaning and janitorial care. The doctors aren't smart enough to even diagnose a bowel blockage in that place. According to them it was just a tummy ache. Yeah thank God I finally landed at Mercy. They diagnosed me properly and saved my life. On top of everything else their billing department wasn't even smart enough to properly submit their claim to my Medicare advantage insurance plan.The incompetence from top to bottom is astounding at Freeman so I'm not surprised they're being sued. They're always being sued .

DeleteYes, I just had an issue with Freeman Hospital, and filed a Complaint with their Risk Management Group. One of my Relatives, who I am their Medical Power of Attorney / Durable Power of Attorney for, because they are Bed Bound and unable to Communicate and Advocate for themselves was Discharged back to a Nursing Home, without my Prior Consent or Contacting Me.
ReplyDeleteNeither I or any of our Family Members where there that Day at the Hospital, when the Doctor placed the Discharge Orders, so neither I or our Family was able to Asks Questions or Get an Updated Status of their Conditions, before they Scheduled to have the Ambulance Transport them back to the Nursing Home. What a Trauma when I called the next morning to check on their Status and was Told that they were not in their Room and when they figured it out they finally told me that they had been Discharged back to the Nursing Home the prior day. When I called the Nursing Home - They Stated that Freeman Hospital was responsible for Contacting the Family, before proceeding with Discharge and Transfer Orders.
We were extremely UPSET and DISHEARTENED THAT THIS VETERAN WAS TREATED THIS WAY.
Every person who works in a medical facility knows that is the number one rule. Don't look in a medical record unless you are authorized to. Never discuss a specific patient with anyone not privileged to know the information.
