Probable cause: Neosho man tells trooper 100 baggies of meth in car were for his own personal use


The Lafayette County Prosecuting Attorney's office filed felony methamphetamine possession and unlawful use of a weapon charges against a Neosho man following a Highway Patrol traffic stop Wednesday on I-70.

Bond was set at $15,000 cash or surety for Daniel Wayne Rose (DOB 1989).

According to the probable cause statement, the trooper pulled Rose over for failure to signal and noticed "indicators of criminal activity."







From the probable cause statement:

I asked Rose for consent to search his person, which he consented to. ln his pants pocket, I located a clear plastic baggie containing a white crystal substance, which appeared to be methamphetamine. 

While searching the truck, I located a second bag containing approximately 2 grams of a white crystal substance on the driver's seat, which appeared to be methamphetamine. 

ln the center console, I located a black Phoenix Arms .22 Caliber handgun. The gun had a full magazine of ammunition. 







ln the back of the box truck, a small metal box was located. On the outside of the box was titled, "Drug Box." Inside the box, I located approximately 100 small baggies, two digital scales with white residue on them, and a glass smoking pipe containing a white residue. 

Rose was advised of his Constitutional Rights per the Miranda Decision, which he indicated he understood his rights. Rose claimed ownership of the contraband. He indicated it was for personal use. He denied selling methamphetamine.

    Throw his azz in jail. Does he want everyone to believe in the Easter Bunny too? With 100 small baggies, two digital scales, and loaded handgun in his car, sounds like a Distributor to me. If he can sell that bunch of crap every drug dealer in the country would want to use that defense to receive less jail time. Meth User vs Meth Dealer / Distributer / Manufacturer, all have different and more severe Jail Times, so good luck the evidence is by far stacked against you. Plus, all these Meth Dealers / Distributors / Manufactures, once they get people hooked causes more crimes since these Users have to Rob and Steal from Others to Pay for their Drugs.
