Rep. Ed Emery, R-Lamar, is asking for a continuance of his scheduled 9 a.m. Monday, April 3, hearing in Lawrence County Circuit Court on a charge of failure to drive on the right half of the roadway.
Court files indicate the motion was filed March 20 by State Senator Jack Goodman, R-Mount Vernon, and asks for the delay because of Emery's service in the legislature, which is in session on that day.
The charges were filed following a 2:20 p.m. Feb 3 accident on Highway 96 two miles south of Miller. Emery and a woman in the other car suffered minor injuries, according to the Missouri Highway Patrol report.
According to the Feb. 7 Lamar Democrat, the accident took place on Highway 96, two miles south of Miller at 2:20 p.m. The Democrat quoted the Highway Patrol report as saying Emery was driving a 1998 Oldsmobile Intrigue west on 96 when he crossed the center line and hit a 2003 Ford 250 driven by David Wiggins, 46, El Dorado, Kan, then hit a 1998 Oldsmobile Regency driven by Virgie Thomas, 76, Miller.
The Democrat article indicated Emery was treated for minor injuries at St. John's Regional Medical Center in Joplin, while a passenger in the Thomas vehicle, Goldie Neeley, 80, LaRussell, was taken to McCune-Brooks Hospital, Carthage.
Despite the motion, court records do not show any change in the hearing date.
