Newton County prisoner's alleged flip-flop theft leads to assault charge


A Newton County prisoner's attempt to steal a pair of county-owned flip-flops as he was being released led to a fight with deputies and two new assault charges according to a probable cause statement filed today in Newton County Circuit Court.

The Newton County Prosecuting Attorney's office charged Jeffery Holden (DOB 2006) with third-degree assault, a felony and fourth-degree assault and stealing, both misdemeanors.







From the probable cause statement:

On June 17, 2026, at approximately 2045 hours, I, Cpl. Starkey was dispatched to the Newton County Jail in reference to an inmate fighting in the booking area.

I arrived on scene and made contact with Victim #1 and Victim #2 who are both employed at the Newton County Sheriff's Office as Correction Deputies. Victim #1 advised that Jeffery Holden was in the process of being released from custody when he attempted to steal some jail-owned flip flops valued at approximately $10. 

Victim #1 advised that when he and Victim #2 went to stop Jeffery, he fought them. Victim #1 played video footage from the laundry room, and I observed the following.

Jeffery is seen walking into the laundry room and grabbing a pair of orange jail-owned flip flops. Victim #1 and Victim #2 are seen following him and trying to take the shoes away. Jeffery doesn't comply, and they begin to scuffle.

During the scuffle, Victim #2 is seen picking Jeffery up, and Jeffery is seen attempting to strike Victim #1 in the ribs with his left knee.








Victim #1 advised that Jeffery told him he was going to keep his orange jail flip flops, and he was told he could not. Victim #1 stated that Jeffery stated "On my momma, I'm going to keep those shoes" then walked into the laundry room.

Jeffery was uncooperative during my contact and refused to speak with me.

Jeffery was in custody from an incident with the Neosho Police Department where he was arrested for Burglary 2nd, Assault 3rd on a special victim and resisting arrest.

I was notified that Victim #2 had been scratched during the fight in the laundry room. I observed a large scratch on his left forearm going from the middle of his forearm up towards his elbow. Near the elbow, the skin was broken and bleeding. Victim #2 wasn't sure if the scratch came directly from Jeffery or from an object during their fight. I took a picture of the injury and placed it into digital evidence.
