An Anderson man was bound over for trial on a rape charge following a preliminary hearing Wednesday in McDonald County Circuit Court.
The trial court arraignment is scheduled for 9 a.m. June 9 for Daniel Vaca (DOB 1995) with Judge Kevin Selby presiding.
The allegation against Vaca is detailed in the probable cause statement.
{A woman} stated she went to the casino with a male she identified as Daniel Vaca. {She} stated she was drinking in his car and in the parking lot at the casino. She did not remember the ride home, but stated when she woke up the next morning, she was still hung over and {saw} Vaca on top of her having sex with her.
{She} later messaged Vaca asking why he had sex with her while she was asleep and he stated he thought she wanted it.

Daniel Vaca, definitely took advantage of this woman and should pay the consequences by spending time in jail. But you Women need to Stop putting yourselves in situations that could end up bad. Stay away from Losers and Perverts, Bars, Alcohol, and Drugs - and her own remarks - {She} stated she was drinking in his car and in the parking lot at the casino. What do you think is going to happen - When you make bad choices and do stupid things - Stop becoming a Victim and have Respect for yourselves - so you don't end up on the news, in police reports, or in the hospital - same with all you dumb men - and ruin your lives!

Personally knew this man and out of the 3-4 months we talked he was 7 years older than me and was against alcohol and NEVER made me feel uncomfortable, not defending him people DO AND CAN change but just shocking if it is true. He was rlly heartbroken and hated me after I called things off because I wasn’t really looking for anything serious but he was a good guy when I knew him. This is actually crazy to me though. Went to the casino with him too and never had drinks together. Sorry for the girl that’s going through this tho im sad for you and hoping you get the help you need after this experience.

When he worked at walmart, him and his red headed friend (also named Daniel) always tried to flirt with the teenagers.
This case was dropped. There is no longer a court date.
