Federal grand jury indicts Joplin businesswoman on 25 counts of fraud, forgery


It was part of the city of Joplin's much-celebrated downtown renovation.

What had once been a ramshackle building was restored through the creative use of grants, and public and private financing. Instead of being a blight on the landscape, the building at 424 S. Main became an interior decorating business, Evergreen and Amber, run by two local women with drive and ambition.

The business, which opened in 2007, was dead in the water two years later, resulting in a Chapter 7 bankruptcy for one of the owners, Peggy Newton.

It may not have been the dire economic climate that spelled doom for Evergreen and Amber. On Tuesday, a federal grand jury indicted Peggy Newton on 25 counts of fraud and forgery. The indictment was filed today in U. S. District Court for the Western District of Missouri.

The indictment alleges that Mrs. Newton forged the name of her business partner, Diane Pine, setting up numerous credit card accounts, wrote 393 checks for her personal use, wrote four checks to her husband, Newton Jewelers owner Brian Newton "for unauthorized reason", used company money to make one of her husband's car payments, and "altered or falsified" documents to make it appear that payments were less than they actually were, or were to someone else rather than the actual recipient.

On approximately 500 occasions, the indictment says, Mrs. Newton took money from Ms. Pine's personal credit accounts and Evergreen and Amber accounts "for personal use."

According to the indictment:

"It was part of the scheme that on approximately five occasions, Newton used D.P.’s name, date of birth, and Social Security Number to open new credit accounts without D.P.’s knowledge or consent. Newton then incurred charges on these accounts to conduct balance transfers to other accounts, and to cover shortfalls on other bank and credit accounts."

The allegations first came to light when Ms. Pine challenged Mrs. Newton's Chapter 7 bankruptcy filing.late last year. Bankruptcy court documents indicate Mrs. Newton claimed she owed $320,358.09 and had only $3,778.85 in assets.

In her challenge to Mrs. Newton's bankruptcy, Ms. Pine claimed her former business partner had "engaged in a pattern of fraud and deceit." Ms. Pine described herself as primarily an absentee partner who spent most of her time working as a registered nurse in Dallas, Texas, though Joplin was her home.

Ms. Pine said Mrs. Newton used company money for various personal reasons, including shopping sprees, paying off her personal debt, paying off her husband's personal loan, tuition for her child to attend College Heights Christian School, and membership in the Millennium Tennis Club.

Ms. Pine filed credit card statements which she claimed show Mrs. Newton paid for vacations, clothing, groceries, and meals with company money or by forging Ms. Pine's signature. The claim also included meals with the statements indicating Mrs. Newton used the credit cards to cover meals at everywhere from Moe's Southwest Grill to McDonald's, Sonic, Burger King, and Fuddrucker's.

In the bankruptcy court documents, Ms. Pine said Mrs. Newton took $108,369.53 in cash from company bank accounts.

In the response that was filed to Ms. Pine's claims by bankruptcy attorney Norman Rouse, Mrs. Newton denied all of the allegations.

This is not the first time she has stolen other peoples money or messed with their credit. She stole a Newton Jewelry customers credit card and paid off her own debt with it. Hopefully she won't be able to buy her way out of this indictment like she did with the card incident.

Mr and Mrs. Newton have a child together, but lied and paid there way to acquire another child. With Mrs. Newton looking good behind bars. Whats the future for those children? Pray for them cause about 16 years ago he signed his rights as a father away from two beautiful daughters, DUE TO MONEY. ha ha ha I think i see a patter.

Brian Newton has done this also, he did it years ago to a family friend he was working for. They're a pretty sad group of people and they are very good at keeping it under the rug. Our local paper is refusing to print anything on the story as of today. However Fox 14 is on it!!!!

If I were her attorney, I certainly would try to use this blogsite as an example of pre-trial publicity creating an atmosphere in which a fair trial is difficult if not impossible. (Indeed, because comments are "anonymous" anyone could be making negative remarks simply to forward this purpose.)

-let me just start by saying peggy doesnt have a BMW. haha but she does in fact have a pretty face. first of all the lawyer that killed himself was the 'stolen childs' lawyer and it is very disrespectful to him and his family for even being metioned. The child wasnt even stolen. she wasnt happy where she was because her mom was crazy. she made up lies about this kids family so she could turn her against them. KARMA. it didnt work. this kid is happy where she is and loves her MOM, PEGGY, very much and can i just say that theres two sides to every story people and indictment means that a certain person is being accused of a criminal offense. THAT DOESNT MEAN THAT SHE IS GUILTY. peggy doesnt drink starbucks. her child does though[= and that doesnt mean that Newtons isnt a great business and isnt full of great people. That family is fun and kind and loving. Jessica dats right... well spoken sunshine! Your birth mom was found to be unfit by a court - you were not stolen. You were lucky that a lawyer could intervene to remove you from your terrible situation. I think it's great that your aunt/uncle (Mom and Dad) could provide, care, and love you unlike your birth parents could. Having a loving family like the Newtons has nothing to do with these allegations and situation. I find it funny that Joplin people (including your birth mom) are "bold" enough to post their overt opinions, but too chicken shit to claim or say who they are. Love you Jess. I believe Peggy Newton will serve time for her crimes and I also believe it is Karma kicking her ass for all the wrongs she has done. As for Jessica she is an awesome young lady that got caught up in what the Newtons had to offer ($$$$$) but it was always conditional as for Jessica's mom Ledina her only mom they won by default because they had the money to fight it out and her mother did not but now everyone knows where Peggy and Brian Newton get their money and finally it has come to light and god willing she will do time in prison for stealing and for thinking she was above the LAW!!! And who the hell wrote that Peggy has a pretty face like hello what does that have to do with anything. Like it or not Peggy may not be able to steal money this time to buy her what she wants.

I feel terrible for Jessica, Peggy and all else involved, including my mother. We tried working with Peggy to figure all this out until she told us to stop contacting her and contact her attorney instead. We spent weeks going through all the finances, requesting duplicates of all the information that was conspicuously missing, and were absolutely mortified and destroyed to find out that hundreds of thousands of dollars were missing. My mother was nearing retirement, had worked hard her entire life to finally own her own home without a mortgage, thought that she had enough savings to retire in modest comfort, and had developed near perfect credit- Now she has lost her house, lost her credit, is going bankrupt, and at 64, is having to work again barely making a living with no means of retirement. Since Peggy would no longer talk with us, we had no choice but to go to the police and ask them to help us figure out where all the money went and where all these charges came from. And today we heard just like everyone else, that Peggy has been indicted for embezzlement, identity theft and fraud. Apparently that’s where the authorities think the money went. An indictment doesn’t prove guilt, and there will be a trial unless someone makes an admission. And if it ends up being proven that Peggy did indeed ruin my mother financially, it will only further break my family’s collective heart, as well as bring more pain to Peggy’s family. Lord knows that my mother, my sister, myself and I all wish more than anything that we could wake up from this nightmare to find out that someone that we loved like a sister and daughter didn’t steal and ruin our mother’s security away – so it would be comforting to find out that Peggy didn’t do it, but time will tell and the truth WILL come out – and unfortunately so far, Peggy is looking pretty suspicious, at least to the federal government and grand jury. My family is praying for Peggy, we are praying for her entire family, and we continue to pray for our mother and ourselves. I can tell you that I certainly don’t believe anyone ought to be dragging anyone’s children into this… enough people have already been hurt, there’s no need to hurt anyone further.

Up here in Nixi, we had a city employee steal from us to buy things. This guy and his wife believed the most important things in life are things. Well, the things they thought are important are gone, or at least going to soon be gone.

Kinda looks like the Newtons are in the same boat. Hopefully, a good end will be that they hve to give up enough things to pay back the ones they have taken things from.

I am not sure yet whether it is being censored. I have heard that Jeff Lehr of the Globe is working on a story for the Saturday edition. The stories that have been written so far have come from the news release issued by the U. S. attorney's office. The extra details from the court filings, both in criminal and bankruptcy, have not been included at this point.

You downtown wannabes need to get it through your dense thick skulls that this kind of immoral, Un-Christian nonsense has got to be stopped. This is Middle-America, where people live on Family Farms, in real houses, in real neighborhoods, go to church, try to raise their kids to be moral productive citizens in society. We belive in the values of hard-work, faith, family, and the teachings of the Bible. These are the kinds of values that you get on the farm, out in the country, away from the evils of the big cities. What kind of moral lesson does it send when Joplin is 'building lofts because that's what they are doing with old run-down buildings in bigger cities like Chicago or New York'. Well I got news for you. This is not anywhere near those kinds of places, thank God! We don't want your silly attempt at turning the Four-State area into an urban cesspool full of smog, crime, mass-transit, strip-clubs, bars, gangs, subways, panandlers, terrorism, skyscrapers, and whatever else poisons the landscape of this earth in those big cities. If you belive in God and care about what kind of future you are going to leave for your children, I strongly encourage you to protest against this and any future downtown residental development, along with protesting the current developments that have already opened-up. Go to future city-council meetings and voice your opinion. Write letters to the editor of the local newspapers. Talk to your county commissioners. Write your state congressman if you have to. Local businesses can refuse to serve people who live downtown (in fact, I wish every one of them would). I've been a family farmer around these parts all my life. This is an insult to the moral fabric that I have worked so hard to instill in my family. This is NOT the America I used to know. Nor is this the America I want for my children. Let me ask a question. Which pursuasion of people commands greater respect? The farmer, who works the fields in the natural countryside from dawn to dusk, to make an honest living for himself and feed the world? Or the New York Wall Street fat-cat, who is directly responsible for the current economic crisis? Which of those two do you have more overall respect for? Which of those two would you rather have setting an example to live by? Which of those two types of people do you think the Joplin downtown crowd is trying to imitate? It doesn't look to me like those downtowners are wanting to be more like farmers and ranchers. Seems to me like they are trying to act like the Fat-Cat Wall Street New Yorkers. And that certainly should not garner respect from a decent society. As a rural Southern Baptist, I find this whole thing with the 'downtown' grossly offensive. That is why I do my shopping in Neosho now. And I strongly encourage everyone else to do the same. Boycott Joplin and take your money elsewhere as long as there are people living in downtown lofts. I pray to the Lord that those people will come to their senses, especially the city council, and see what a mistake they are making. I am going to find out the names and employers of those people living downtown, and write their employers and tell them that I refuse to do business with them as long as they hire downtown dwellers. This is what we need to do to get the message across that we will not tolerate those downtown people's lifestyle or will help fund their sick, twisted, urban agenda.

I have been coming back to read the comments regarding this article compulsively.... The comments have made me laugh out loud a few times but mostly the whole situation just brings tears to my eyes. This is a very sad situation for everyone involved and Mike certainly has it right. If this could have been resolved by any other means it wouldn't have become so public but that solution was obviously not feasible. I can only hope that eventually the dust will settle and this will all be a thing of the past so the involved parties can move on with their lives. I have never in my life seen such a trash act that you all displayed in this blog. I feel for all the parties involved especially the children mentioned! I personally knew both women and it disgusts me to see both of them ripped apart by people that don't even really know the day to day operation that they were both responsible for. I witnessed both women not acting responsibly in the business . They both were in denial and took from the business. They were both foolish! Ms. Pine was active in financial affairs as was Mrs. Newton. They both took draws from the business and were way too generous to their helper who were paid in cash. I was paid in cash a couple of times helping there. I witnessed them giving one helper a huge oil painting and a fur coat. They would tell about their fun trips to market and I remember when Ms. Pine told me on several occasions that Mrs. Newton signed her name more than she did and laughed about it! She also would have Mrs. Newton speak on the phone to creditors as her! Yes I worked on several
occasions and she would tell me if the phone was for her that Peggy was to her! I actually saw this first hand! I think Ms.Pine was too embarrassed to admit it and this has unfortunately turned into a nightmare for both women. These women both would give the shirt off their back to help someone. I hope Ms. Pine was misquoted in the globe because it is very untrue about 2 credit cards being paid off in the total of 140K bc she combined her car loan and several other credit cards. I witnessed such. Mrs. Newton worked a lot more than Ms. Pine. Both foolish women that made stupid stupid mistakes! I love both of them and pray they will both heal from this terrible situation. The families involved are both supportive of their loved ones. I hope none of you have your life under a microscope.

This is America - where people live in homes and on farms, not in high-rise skyscrapers. Real people don’t live in downtowns. These loft people need to have their doors kicked down and be greeted by a 12-guage double-barrell shotgun. Someone needs to show these loft people that you don’t mess with the American farmer. This “downtownism” is a slap in the face to everything that you fought for in wars. You fought to depend and preserve the American way of life. These loft people downtown are spitting on everyting you fought for.

What blows my mind is how we can build actual real homes with all the modern technologies and amenities, places made for humans to live in, and here in Joplin we have a certain group of people in a certain area of town who actually choose to dwell in some dilapidated shell of a warehouse filled with ugly furniture, then turn around and have to brag to us non-stop about their “fancy upscale” lofts.

I’m of the 4th generation in my family to be born and raised on a family farm in northeastern Jasper County. My family has always cherished and believed in the lessons of values and morals that one gets with growing up and living out in the country on a farm. To this day, I try to pass along those values to my children. When I see this “downtown living” stuff going on like it is down there in Joplin, it is a slap in the face to everything I work for and value, and try to instill in my family. Those big-city-like people who live downtown Joplin are a bad example for my children. It’s hard enough to raise good respectable kids in this world today without having people like this doing and living like those downtown people do.

No doubt what does downtown living have to do with this case? The business was downtown, but that is all. I have read these posts and think who are the horrible freaks making these posts? God help the lawyer, as Mrs. Newton could not get a fair trial in this town...why freaks and jealousy. It happens everytime someone in the uppermiddle class makes the papers, I can think of at least two doctors and a businessman people ragged on them and harassed them and their families till the sun set. I knew two of them and all the people of Joplin did was hurt Joplin by being so ugly. I know the dr did not get a fair trial, and his case, this too was a result of a partnership gone bad. Revenge is a great motivvator

This woman's worst and first mistake was locating in downtown Joplin among the big-city-wannabe loft dwellers. The life-long farmers, ranchers, and other folk who live out in the countryside are the real moral backbone of America. We country-folk are the ones who make America great, not those downtown loft dwellers. We are the ones who get up early in the mornings and put in a hard-day's honest work, and who always do the right thing and live the moral lives as God teaches in the Bible. We are the people who are respected and admired, and who children look up to for a moral example to follow. Those downtown loft people represent everything that is immoral, unjust, and corrput in modern society. Serial Killer Ron Erwin, and now this crook, are both products of a "downtown revitalization" and "new urbanism" culture that has turned downtown Joplin into the civic and region-wide outrage and source of embarrassment it is. You ask anyone in this area what their opinion of the downtown people are - and you will hear an expression of moral outrage and a desire to see those people run out of town.

Lesson in Life
A person needs to remember where they come from, to make a good life for ones family is fabulous, but when times get hard it is a lot easier to go backwards than to try keeping up a high society life style. That tends to lead into a life of sin and embarrassment and shame. It's sad and heart breaking to see a person destroy their life for the worst. When they think the way they grew up was the worst, at least it wasn't embarrassing or a sin. It is easier to go back wards than fall into a life of crime. I Love you Peggy, and sorry you thought you were to good for the family who would of helped you. I hope this gets to everyone to remember you can all ways go the way back wards and then you can later climb that high road again in life. You know our Mamas are rolling over in their graves. I'll pray that it isn't to late for you to learn life isn't worth a life of crime you will all ways get caught and ruin your family life.

This just goes to show that 99.99% of the people of the Joplin area HATE the downtown crowd! They HATE the lofts, the restaurants, the urban lifestyle, the want to act like a big city. Ask anyone in town, and they will tell you that they would like nothing more than the see the downtown lofts bulldozed down and the people living in them run out of town.

Some of you have forgotten or haven't been informed. Brian & Peggy Newton have NEVER been downtown loft people and thanks to Peggy will Never be downtown loft people. Unless, of course, they lease one to the Missouri Prison system! :)

Brain and Peggy are just trying to live up to the Newton name. Neither of them are REAL Newton's.

Neither of them has the businesss sense to pull off having the Newton name. What little Brain may have had Peggy has made sure that their will be no more business for them in Joplin.

So leave the lofties alone and concentrate on the real issue. The BAD seed brought into the Newton family, Peggy.

This summer, when the downtown people have their "Third Thursday Art Walks", you're going to see firsthand just how much the downtown people are hated by the life-long residents of Joplin and the surounding countryside. We are rounding up farmers and ranchers, along with other folks who live out in the country around the Ozarks, and we are going to have the world's biggest anti-downtown protests on Main Street you ever saw. We are going to show up in the thousands at the "Art Walks" and make it known to the downtown people, the city fathers, and the local news, that a downtown city lifestyle is unwelcome and unacceptable. It is Un-Christian and Immoral to live in a big city or anything resembling a big city, which is what the downtown lofts do. YOU DOWNTOWN LOFT DWELLERS BETTER HIRE A PLATOON OF BODYGUARDS, BECAUSE WE FARMERS ARE COMING AND WE ARE GOING TO PUT A STOP TO YOUR CITY LIFESTYLE!!

If you are really a farmer and are true to your beliefs and values, why are you not protesting outside the downtown Joplin lofts and businesses? Why are you not demanding the loft crowd be removed and the downtown apartments be closed and demolished? Why do you allow city people to get away with living their urban lifestyle when you can stand up for what you believe in and put a stop to those people?

2:22, your knuckle-headed premise is that farmers somehow have innate beliefs that require them to protest the very existence of city folk, cities, modernization. You then suggest the criminal demolition of private property.

A friend of mine believes that whack-tards like you should be rendered unable to breed, so that your defective genetics cannot pollute the already diseased SW MO gene pool any further.

All i have to say is karma is a biotch and will come back to get her! I know a man who was told to sign his rights over to better HIS daughters life and he would get to see her more than what he was getting to see her at the time. So thinking it was for his daughters grater good he willingly signed the papers. Well needless to say that did not happen. Peggy is not her mom and never will be and Brian will never ever, EVER, BE HER DAD.To think money could replace love, makes no since.

Unfortunately for the REAL father and mother, that is what the child wanted. She chose the life of luxury over her parents love. She may have been brainwashed or inticed but SHE made the choice. A choice she will have to live with the rest of her life.

Fortunately for her, her REAL parents do LOVE her and only want her to be happy. Question is will she be happy when the luxuries run out? She has learned some very bad habits from her psuedo family and those will carry on to her adult life. Which means she will struggle to survive, will probably have an addiction, and several failed relationships.

Just be thought a RICH kid! So sad, So sad......

Go back to high school and learn how to spell, you trashy, stupid, illiterate, sorry excuse for a lady. And then id like to remind you, miss thang, that you slept with my dad when you were 15 years old. THATS YOUNGER THAN ME. So, no ma'am i do not want anything to do with either of you. I told dad that if he got rid of you then id see him and he said no. so that was his big ol' mistake.
