Newton County, Neosho officials to pay $630,000 to mother, children of Joplin man who died in county jail


The mother and children of a former Joplin resident who died June 29, 2018 in the Newton County Jail will receive a $630,000 settlement, according to documents filed today in U. S. District Court for the Western District of Missouri.

Kristina Stockton, the mother of Forrest Stockton, and his two children Gatlan Stockton and Adelyn Cervin, will each receive $210,000, minus attorney fees and expenses.

The Newton County Ambulance District and Newton County will each pay $300,000, with the City of Neosho responsible for the other $30,000, according to the settlement documents.







In the lawsuit, Stockton alleged Neosho and Newton County officials denied her son proper medical care during a medical episode that occurred while he was high on meth.

Following the death of Stockton, 30, Newton County Sheriff Ken Jennings said suicide had been ruled out as a cause, but he may have died of a drug overdose.

Kristina Stockton alleged negligence by Newton County Ambulance, Newton County Sheriff's Office and Neosho Police Department employees, says the city and county failed to properly train employees and claimed her son was denied medical care.

All of them should have recognized there was a serious problem, the lawsuit claims.

Listed as defendants in the lawsuit are Newton County Ambulance, Newton County, City of Neosho, EMT Dennis Lake, paramedic Bryan Smith, Newton County Sheriff's Office employees Kelse Renner, Michael Barnett, Steve Lee and Tessa White and Neosho Police Department officers Cody Bunch, Dustin Doty and Rodney Howe.







The details of the allegations are spelled out in the petition:

On June 29, 2018, Defendants Bunch and Doty, commissioned officers with Neosho PD, were dispatched in reference to a disturbance.

They arrived at the dispatch location at approximately 6:01 pm and made contact with Forrest Stockton in the yard of a residence.

Defendants Bunch and Doty immediately noted that Mr. Stockton was lying in the side yard, rolling around, yelling incoherently. His breathing was labored.

Defendant Bunch stated that he believed that Mr. Stockton was “under the influence” but was unsure of the substance. Defendant Bunch watched as Mr. Stockton stood up and leaned against a fence while swaying back and forth.

Mr. Stockton kept jerking his body and moving sporadically. Mr. Stockton then fell on his back and again began rolling around. While rolling around, Mr. Stockton spit up what Defendant Bunch believed to be blood. Defendant Bunch called dispatch for an ambulance from Defendant NCAD.

Defendants Bunch and Doty observed Mr. Stockton continue to roll around on the ground yelling incoherently. Defendant Doty asked Mr. Stockton his name, and Mr. Stockton replied, “Forrest.” Mr. Stockton was intermittently able to communicate notwithstanding long periods of severe delirium.

According to Defendants Bunch and Doty, Mr. Stockton continued yelling unintelligible words and grunting between statements. Defendant Doty asked Mr. Stockton his last name, and Mr. Stockton replied, “Stockton.”

Defendants Bunch and Doty noted that Mr. Stockton was wet and muddy with ridged muscle tone. He was sweating profusely. Mr. Stockton moved to the backyard and continued to alternately stand, fall, sit, lie down, yell and roll around. His breathing continued to be labored.

Defendant Howe, a commissioned officer and detective with Neosho PD, arrived to assist Defendants Bunch and Doty. Defendant Howe observed Mr. Stockton rolling around on the ground. Defendant Howe stated that he believed Mr. Stockton was on some kind of narcotics based upon the way he was rolling around in the dirt and yelling. Defendant Howe further observed Mr. Stockton yelling unintelligibly and sweating profusely.

At 6:22 p.m., Defendants Lake and Smith, licensed EMS providers with NCAD, arrived to assess Mr. Stockton. Defendant Howe continued to observe Mr. Stockton’s erratic conduct and his interactions with Defendants Bunch, Doty, Lake and Smith.

Defendants Bunch and Doty placed handcuffs on Mr. Stockton without incident for an assessment by Defendants Lake and Smith. Mr. Stockton cooperated while Defendants Lake and Smith stood apart from him and they looked in his nose and mouth for blood. They found none.

I really hope nothing like this ever happens in your family. You're an ableist bitch. He deserved medical care regardless of what happened, THAT'S THEIR JOB, which they failed to do, so in return, they shell out the dough.

This comment an absolutely disgusting but perfect example of why this man wrongly lost his life. How dare you say that his "family deserves nothing" or that "he had it coming" because he was an addict. Shame on you and those responsible for his death. Addiction does not dictate a person's right to care, dignity, respect, and life. Nor does any other illness, personal idenfier be it race,socioeconomic status, or disability dictate a humans right to theses basic considerations. The fact of the matter is these officers and first responders failed in their obligation to provide care to Forrest, and in doing so cost him his life. Not only did he not have it coming and his family most certainly deserve the restitution, though small and inadequate, but Forrest and those who have lost their lives or suffered injury or trauma at the hands of these officers and other officers like them deserved more. They deserve to not have been tortured and treated with cruelty, to have received the help and care they deserved. The help and care that those in positions of power, trust, and authority are obligated to provide, not this horrendous misuse of those positions. The officers and first responders involved deserve criminal charges and real consequences!

Symptoms of heat stroke: headache, dizzyness, excessive sweating, red skin, rapid heartbeat, rapid shallow breathing, confusion or disorientation, slurred speech, high temperature, agitation or irritability, trouble walking, nausea or vomiting, pinpoint pupils, loss of consciousness.
He was having a medical emergency and should have been in the hospital NOT STRAPPED TO A CHAIR IN A JAIL.

You can tell Randy Turner disagrees with the settlement. This story is missing a lot of details and has been written to demonize Mr. Stockton. He left out all kinds of stuff. Purposely. I'll be taking note of this and make sure I let everyone know what kind of blog this really is any time Randy Turner comes up in conversation online and in person.

This ia a everyday occerance in neosho. Unless u work for gov or city you will get treated wrongly or falsely even if u r sober. I have lived there over 35+ yrs the downfall in last 20 yrs is sadd!
I was shot at by a felon in 20017 while looking at a rental property. Another felon arrived pointed gun at me during this altercation also. Both never was arrested one sat at home!the other went to hospital for injuries sustained for pointing that gun at me
My best friend was only help n blessing i had there!

I'm very sorry to the family he deserved help. If the family ever reads this I would love to know u lawyer. My son also died in hand cuffs in back seat asking FOR HELP TO GO TO HOSPITAL !!!! No he was denied and arrived at the jail dead. Jan 26 2018. There is tooo much of this that goes on. His report was 83 pages long. Plz contact me if the family reads this

In response to the anonymous fool who posted at 2:56 a.m. Judging from what you wrote, the problem is not with the media, but with your reading comprehension. When I am writing a post like this, the information comes entirely from public records and if you had bothered to read the story carefully, you would have noticed that nearly everything in it comes from the lawsuit petition- which was written by the Stockton family's lawyer. There is absolutely nothing I added or left out that served to demonize Mr. Stockton. You might want to consider that if I had not written this, only a few people would have ever known about this lawsuit or the details (as offered by the Stockton family's lawyer) about what happened to him.

And if you ever want to comment on this blog or any of my blogs again, grow up, clean up your language.

In response to anonymous at 2:50 a.m., who is likely the same person who commented at 2:56 a.m.: How in the hell do you think that shows I did not think the Stockton family deserved the settlement? In this settlement and most settlements of this kind the people who are being sued pay the money, but do not acknowledge they were at fault. The only version of the events leading to Mr. Stockton's death ever put out by the defendants came in the days immediately following his death. Therefore, if I write that it happened the way it was laid out in the lawsuit is the way it happened, I am vouching for that version of events. Therefore, I use the word "alleged." I will once again point out that if I had not looked into this lawsuit, nothing would have ever been written about it. And what I wrote about it was his mother's lawyer's version of the events, which she certainly approved before the lawsuit was filed. Over the past 44 years, I have received criticism many times for things I have written and sometimes I deserved the criticism. This is not one of those times. I hope you live up to your promise and tell everyone what kind of blog this is.I am guessing people will consider the source and some might even start reading the Turner Report because of it.

We're glad you did. Thank you. Life can really sting sometimes. Forrest was a one of a kind soul. I miss him dearly and anyone who knew him I hope feels as I do, that the negative comments above just serve to highlight how serious the problem is. It's a social bias that is very prevalent. Some form of social darwinism? Anyway, you can't judge a book by its cover etc... Bless all forms of consciousness.
