Jasper County Circuit Court Judge David Mouton approved a $150,000 settlement in the wrongful death lawsuit filed by Samuel and Tonya Berry, Lockwood, following the October 19, 2024 death of their son, Tucker Berry, in a golf cart accident in Carl Junction.
The defendants in the lawsuit were Brant Cullen, Carl Junction, and Kreg Myers, Cassville.
According to the judgment order, which was filed Friday in Jasper County Circuit Court, the Berrys will receive $99,266.13, while the Cowherd Law Firm will receive $50,736.87.
The settlement specifically does not contain any admissions of liability for Tucker Berry's death.
Another lawsuit, which was filed in Lawrence County Circuit Court by Samuel and Tonya Berry against Kreg Myers and American Family Mutual Insurance was dismissed January 30 at the Berrys' request.
Cullen, who is facing a first-degree involuntary manslaughter charge in connection with Tucker Berry's death, was bound over for trial following an October 4 preliminary hearing in Jasper County Circuit Court.
A pre-trial conference is scheduled for 9 a.m. Monday.
