A sentencing hearing is scheduled for 9 a.m. Monday in Jasper County Circuit Court for Raven Cheyenne Gomez, 28, Columbia, who pleaded guilty September 30 to third-degree assault.
Gomez was originally charged with first-degree assault, but the charges were reduced under a plea agreement.
The probable cause statement indicates Gomez and Brandon David (DOB 1978) were fighting in the parking lot at Pete's Convenience Store when the Jasper police officer arrived.
After that, the officer became disoriented, according to the statement.
David left the car and began punching the officers with a closed fist several times in the head and upper body area.
David then climbed into the patrol car as if he planned to steal it. "It appears David wasn't able to put the vehicle in drive due to the different gear shift newer vehicles have.
As that was happening, Gomez returned to her car, backed up and ran over the officer's foot, then ran over it again when she drove the car forward.
David left the patrol car and got back into Gomez' vehicle.
The officer sustained numerous bruises to the face, neck and body, a sprained foot and a softball-size hematoma in the back of the head.

You’re missing the problem. The assistant prosecutor doesn’t make plea arrangements, that’s approved above his pay range be the County Prosecutor Kinney. That’s where the problem lies.
The Judge can only sentence what the prosecutor brings him.
The assistant does what the prosecutor tells him to do.
She doesn’t like going to jury trial.
The other part of this, is how the officer feels about it.
To plea this down to a misdemeanor assault doesn’t appear right on most people accounts.

When the video and the words do not align it makes the officer’s testimony not as powerful. It would fall apart under cross examination. So, they plea it down to what actually happened or what they can prove. Not the egregiousness the officers emotion filled report would have.
Agreed - to an extent. We’ve all seen enough crime shows to know that everything hinges on what the prosecuting attorney thinks they can prove/win in court. The problem in Jasper County is that Theresa Kenney is a weak attorney and has no business being prosecutor. She hates to go to trial and her avoidance causes families to go without justice. Her lack of skills only undermines the work of law enforcement. How she keeps getting elected is beyond comprehension.

Theresa Kenney, the Jasper County Prosecuting Attorney - Lost to Joe Hensley, last August - to take over Retiring Judge Gayle Crane's Job - Maybe she should show a little more Backbone by Prosecuting the Criminals and sending them to Jail, instead of making so many Deals.

Can the judge overrule the prosecutor? Yes. A judge is the person that reviews both sides of an argument and takes into account how the cases play out with objections, but does so in accordance with the laws set forth.
Slap on wrist. Soft judges endanger us all.

Yet this Never Works - You cannot Fix the Majority of Criminals - Today's Criminals Lack Respect for themselves and their Victims - and are not afraid to Hurt their Victims.
These Judges and Prosecutors, will Not take Responsibility for letting Criminals with 5-DWI's back on the Streets, or allowing People who have Robbed, Stolen, or done Other Crimes back on the Streets, with a Slap on the Wrist or Probation, and then these same Criminals end up doing more Crimes -
We have got to Stop being Soft on Criminals. The rising Crime Rates and perceived Disregard for Societal norms, requires that we cannot take a lenient attitude towards criminals.
