Webb City man charged with rape, alleged victim says she feared for her life

The Newton County Prosecuting Attorney filed a second-degree rape charge Wednesday against a Webb City man who allegedly forced a woman to have sex with him by making it clear to her that he had a gun.

According to the probable cause statement, Logan Tyler Upton (DOB 2002) raped the woman following a September 18 back roading expedition in the Joplin area.







The woman told a Newton County Sheriff's Office deputy that after she, Upton and two other friends finished back roading they stopped at a house and Upton began making unwelcome advances, touching her in her private areas, according to the probable cause statement. 

Victim #1 told Logan to stop on multiple occasions. Victim 1 stated she was fearful of Logan because he kept making comments about having a gun and shooting it and stated that he was wearing it on his hip. Victim 1 stated that Logan kept begging her to have sex with him. Logan and Victim 1 went outside and Victim #1 states that after repeatedly saying no, she finally gave in and said, "Fine, whatever," out of fear of him using his weapon to hurt her.
Victim #1 stated that the sex was not consensual and that she only gave in because she was in fear for her life.
