It's time for Lindstedt to have his day in court

(Note: This is a reprint of my column from the April 26 Newton County News.)

Justice may be about to arrive for Martin Lindstedt.
For those who have been on the wrong side of Lindstedt (and that includes most anyone who is living and breathing), having him separated from society for the past two years has been a blessing.

Lindstedt is loud, profane, obnoxious, and just about any other negative adjective you can think of, and even worse, he is awaiting trial in Newton County Circuit Court on a charge of first degree statutory sodomy, a crime that, if he is guilty of it, ranks Lindstedt as the lowest of the low.

Justice, however, has been anything but swift, in the Martin Lindstedt case. Lindstedt was arrested in May 2005 for the crime, which allegedly occurred in March 2003. His next court hearing in the case is scheduled for 9 a.m. Thursday, May 17, before Circuit Court Judge John LePage. Though Lindstedt has either been in jail or in a mental hospital for more than two years, this at long last will be his preliminary hearing...barring yet another delay.

Early proceedings in the Lindstedt case could accurately be described as a circus. He shaved on one half of his face and let his beard grow on the other. He refused to concede that the court had any authority over him and created disruptions every few seconds.

A fed up Judge Kevin Selby eventually leveled 33 contempt charges against Lindstedt and ordered the Granby resident to undergo a mental evaluation. And this was just for seeing Martin Lindstedt do what Martin Lindstedt has always done.

To Newton County residents, and everyone else who has had dealings with him, any time he has filed another lawsuit or filed to run for another public office, we just shrugged our shoulders and said, "That's just Martin."

It was only two years ago that Lindstedt's lawsuit against Governor Matt Blunt was rejected by a federal judge. Lindstedt ran against Blunt in the Republican primary for governor in 2004. Blunt was serving as secretary of state at the time and refused to provide a link to Lindstedt's homepage on the secretary of state's website due to racist content.

In his lawsuit, Lindstedt contended that was an illegal decision. He was also irritated by Blunt's refusal to allow him to use the nickname "Martin 'Lawsuit' Lindstedt" on the ballot. As a solution to the problem, Lindstedt suggested that Blunt be required to run on the November 2004 general election ballot under the name "Matt 'Runt" Blunt." For some reason, Judge Richard Dorr did not agree to this.

For a long time, Lindstedt's lawsuits have been an irritant to the public officials who have been sued, and an amusement to the rest of us.

That all changed when Lindstedt was charged with a sexual crime involving a minor.
At that point, even the racists dropped their support of Lindstedt, who says he is a minister of the Church of the Sons of YHVH. That group expelled him from the ministerial ranks.
Morris Gulett, church leader, in a letter to his small flock, said, "I have been made aware that Martin Lindstedt, from a jail cell in Grandby (sic) Missouri, is writing and distributing some very disturbing ideas, such as and I quote, 'Prion Poisoning, which is the mass poisoning of wild game food sources. The skinning alive of prisoners and execution by slow torture and the gang rape of female whigger herd animals to use them as brooding stock.' "
Gulett added, "This letter is to make public that this (Lindstedt's status as a pastor in the church) is no longer the case. As of this moment, Martin Lindstedt's ordination as a pastor is null and void and his membership status with the Legion of Saints is revoked. I cannot in good conscience allow anyone who promotes such ungodly behavior and tactics to carry a valid Ordination Certificate that bears our church standard and my signature."
Gulett said he does not believe that Lindstedt is guilty of child molestation.
Gulett is no prize, either. He is an Aryan Nations leader, who was arrested in March 1997 for ramming a Dayton, Ohio, police department cruiser with his van. He served one year in prison for that act, following a plea agreement.
The action to expel Lindstedt from the church was taken in November 2005, shortly after Lindstedt's letters became public.
Now it's time for Missouri's judicial system to provide justice for Lindstedt, whether it be a long prison sentence, freedom or something in-between. The value of a society is in how it treats its most despised individuals. To many, he falls into that category.
We may have to cover our ears, but Martin Lindstedt, the same as any American, deserves his day in court.

Another motion filed by Lindstedt

Perennial candidate Martin Lindstedt is keeping himself busy as he serves 660 days in jail for contempt of court and also remains there on $100,000 bond while awaiting a trial on a statutory sodomy charge.
On Friday, Lindstedt filed a second motion asking Presiding Judge Timothy Perigo to "alter, amend, abolish and/or reconsider his lawless and corrupt judgment to unlawfully assign Division III Newton County Juvenile Judge Kevin Lee Selby" from his case.
Lindstedt is asking that Perigo either take the case himself or assign it to Judge John LePage. Lindstedt claims that Selby has a conflict of interest in the case.
While Lindstedt has a long history of filing frivolous lawsuits and generally harassing any official in sight, an appellate court ruling last week does indicate that there may be a question of whether Judge Selby does indeed have a conflict of interest in this case.
The Missouri Southern District Court of Appeals on June 29 ruled against Roxie Fausnaught, Lindstedt's common-law wife in her effort to reverse the removal of her grandchildren from her home. The children were placed in foster care following a protective custody hearing on April 22, 2004, 13 days after the Division of Family Services made an emergency removal of them from the home shared by Lindstedt and Ms. Fausnaught. The reason for the emergency removal is the statutory sodomy charge now faced by Lindstedt.
Ms. Fausnaught's first attempt to overturn the DFS decision was rejected by Judge Selby, according to the opinion. The appellate court rejected her, saying her petition gave it no information on whether she had any right to intervene. "Nothing in the docket sheet guides us to understand the issues in the case." No transcript was included with the case, meaning the judges had no idea if there were any legitimate issues in the appeal.
It would be easy to come to the conclusion that the appeal was actually written by Lindstedt, since Ms. Fausnaught represented herself, according to court documents, and there is one reason after another listed, including some which would indicate there was a conspiracy against Ms. Fausnaught and Lindstedt.
See if you notice anything familiar about some of the reasons listed by Ms. Fausnaught in her appeal.
-"The trial court (Selby) erred before dismissing appellant's motion to intervene unlawfully as proven by his conduct in having appellant's domestic partner (Lindstedt) falsely arrested on April 15, 2004, covering up with this false arrest by means of threatening appellant with bogus and unlawful contempt of court charges, of allowing the Division III court clerks to tamper with the official records and refusing to release these records to legitimate parties to this action, and again threatening Appellant's domestic partner with false arrest and contempt of court."
That certainly sounds like the motions Lindstedt has filed in his current case and in his many past lawsuits.
Lindstedt and Ms. Fausnaught were also upset that Anne Wells had been appointed guardian ad litem in the case, claiming she had a conflict of interest since she had threatened to put Lindstedt in jail when he was creating a disturbance (my words, not his) at a hearing when Ms. Wells was serving as an appointed municipal judge.
The appeal also says Judge Selby, the Newton County Juvenile Office, juvenile officers Pat Stuart, David Jones, Candi Butts, Cathy Gorham, Bill Dobbs and caseworkers Doug Baugh, Linda Rasmussen, Rocky Macy and guardian ad litem Anne Wells "have conspired to steal Appellant's grandchildren, destroy Appellant's family and genetic future, and try to railroad Appellant's domestic partner Martin Lindstedt into prison and have him murdered in prison, for no other reason than because they like to steal and destroy the families of the poor and their political enemies for their own political agenda and self-interest."
What is most amazing about this appeal is the commendably serious manner in which the judges handled it. The opinion included a politely phrased, but clear slap at Lindstedt's ability as a (self-proclaimed) lawyer. "While Appellant includes some citations to authority, such citations are misguided and are inapplicable to her claim of error."
Obviously, Newton County officials have a problem when it comes to dealing with Lindstedt. Even if Selby were to remove himself from the case, how can you appoint someone to handle it when, according to Lindstedt, everyone is in on this conspiracy against him?

Selby appears to be a little drunk with power

I just finished reading the Neosho Daily News story on the most recent hearing for accused child molester Martin Lindstedt and my first reaction was shock.
No, I am no longer shocked by anything Martin Lindstedt does. Lindstedt is a racist who files lawsuits whenever the wind changes. Authorities have charged him with felony statutory sodomy. He has run unsuccessfully for every office from East Newton R-6 Board of Education to governor to U. S. Senator.
His rantings are disgusting, especially when you consider that the only reason he is able to rip into society like he does is because he lives in a society that allows him to do so. Nothing he does shocks me.
That being said, the comforting thing about Martin Lindstedt, and yes, there is one, is that we know he will never come to power.
Unfortunately, we cannot say the same about Newton County Circuit Court Judge Kevin Selby.
Read this excerpt from John Ford's story in the Daily News:

"On Thursday, Newton County Division III Associate Circuit Court Judge Kevin Selby ordered both prosecutors and potential defense attorneys to keep mum on the results, as well as all witnesses in the courtroom. In addition to court personnel and a representative of the news media, Lindstedt’s live-in “paramour,” Roxie Fausnaught, was present in the courtroom."

The results Selby refers to are in connection with the mental evaluation that was ordered for Lindstedt. If those results show that Lindstedt is not capable of helping to prepare his defense, and that is what recent postings on Neosho Forums have indicated, then that would definitely bring under question Selby's use of his judicial power a few months back when he levied 22 30-day contempt sentences against Lindstedt for disrupting his courtroom during an unsuccessful attempt to hold a hearing. Consider the following paragraph from the Daily's article:

"Not present, however, was Lindstedt himself. Within seconds of entering the courtroom Thursday afternoon, Lindstedt questioned the court’s authority, legality, and alleged the court of having 'secret proceedings.' He was then escorted from the courtroom by members of the Newton County Sheriff’s Department."

For once, Lindstedt was absolutely correct. The judge was conducting secret proceedings.
This brings into question Judge Selby's understanding of the United States Constitution. Consider what the man did: He held an open hearing and ordered everyone to remain silent about what happened during that hearing. There is a reason why we conduct judicial hearings in the open in the United States. It is to keep society informed...and to protect us from judges like Kevin Selby.

Ohio man sues Martin Lindstedt for $10 million, claims he is being cyberstalked

An Ohio man is suing frequent political candidate and white power advocate Martin Lindstedt for $10.7 million, claiming Lindstedt has been cyberstalking him.

The case, which was originally filed in Ohio federal court, was transferred to U. S. District Court for the Western District of Missouri today.

According to the Ohio federal judge's order transferring the case to Missouri:

Pro se Plaintiff Bryan Anthony Reo, an Ohio resident, filed this action against Martin Lindstedt, a resident of Missouri, alleging that Lindstedt engaged in a campaign to stalk himthrough the internet. He asserts claims for cyber-stalking, harassment, defamation, libel, intentional infliction of emotional distress, online impersonation, and violation of the DigitalMillennium Copyright Act. He seeks $10,750.000.00 in monetary damages and injunctive relief.

Reo states he met Lindstedt when he was invited into an online Skype conference chat in 2010. He contends  Lindstedt became angry with comments he made and took steps to discover Reo’s identity from his screen name. Reo contends Lindstedt then began to stalk and harass him over the internet by posting photographs of Reo on adult internet sites, creating fictitious accounts in his name on internet forums dedicated to pedophiles, or white supremacy groups, and by posting sensitive personal information such as his social security number and voter registration information on numerous internet sites. He claims Lindstedt has threatened him using the internet, and has posted false and defamatory information about him.

Lindstedt has been a candidate for U. S. Senator, East Newton Board of Education, mayor of Granby, and numerous other positions over the year and has filed lawsuits against President Barack Obama, Congressman Roy Blunt, Missouri Southern State University, John McCain, Matt Blunt, Jay Nixon, Robin Carnahan, the Missouri Supreme Court, the Missouri Republican Party, Frazier Glenn Miller, Newton County Republican Party, Newton County Sheriff Ken Copeland, Jay Nixon,

It's a pretty good bet that the next target of candidate for all positions, winner of none Martin Lindstedt will be U. S. District Court Judge Richard E. Dorr.
It was this Dorr who slammed shut Lindstedt's lawsuit against Governor Matt Blunt. The case wasn't dismissed entirely, though Dorr's displeasure with Lindstedt came through loud and clear in documents filed today in U. S. District Court for the Western District of Missouri.
If you remember, Lindstedt, who has been a candidate for everything from U. S. Senator to Sheriff to East Newton R-6 Board of Education, sued Blunt, who held the secretary of state's office at that time, because Blunt would not list Lindstedt on the ballot under his pet name Martin "Mad Dog" Lindstedt.
In his lawsuit, he asked that Blunt be listed as Matt "Runt" Blunt on the November ballot. For some reason, that didn't happen. Lindstedt was also displeased that Blunt would not put a link to Lindstedt's website on the state website, as he did for other candidates.
In his initial response to the lawsuit, Blunt was clear about why no link was established. "Plaintiff's website is inundated with racism, anti-Semitism, profanity, and calls for open revolt against the government," Blunt's response said. "Plaintiff refers to himself as 'probably the most clever and ruthless of the Revolutionary Resistance political activists in Missouri,' and 'the only candidate...who is an overt White Nationalist,' as well as 'a genuine racist.' "Blunt said that he could not quote any further from Lindstedt's website. "Respect for the decorum of this court makes it inappropriate for the secretary to extensively quote from (Lindstedt's) website."
Lindstedt said the claims made in Blunt's response were a "farrago of half-truths, outright lies and smarmy witless pleadings." Lindstedt referred to Blunt as a "moral and mental flyweight." Lindstedt defended his racism, saying it "doesn't hold a candle to that of the Founding Fathers, especially George Washington, Thomas Jefferson, Patrick Henry, etal, who owned entire herds of negro slaves and never thought for an instant that such persons were anything other than property to be disposed of, much less being equal."
In his first ruling issued today, Judge Dorr said that Lindstedt's lawsuit appeared to be against the secretary of state in his official position, "as his complaint challenges conduct in the recent state election." Citing the decision of "Johnson v. Outboard Marine Corp." which says that "in order to sue a public official in his individual capacity, a plaintiff must expressly and unambiguously state so in the pleadings, otherwise it will be assumed that the defendant is being sued only his official capacity."
Applying that decision, Dorr removed Blunt as a defendant and substituted Secretary of State Robin Carnahan.
In his second order, Dorr noted a federal rule that requires that pleadings and motions should not be used for any improper purpose "such as to harass."
He noted that Lindstedt continually referred to criminal acts and said that Blunt should be punished. "Plaintiff also inappropriately refers to defendant as Runt Blunt, not only in the caption of the case, but throughout the filings and engages in other name-calling."
Dorr said Lindstedt also made a number of frivolous comparisons "such as referring to the 'punishment' he wishes for defendant's 'crimes' to be similar to 'a chicken-killing dog forced to wear its dead victims."
Lindstedt also threatened to "do everything in my power to embarrass and humiliate" Blunt.
Dorr gave Lindstedt 20 days to show cause why the case should not be dismissed.

Even racists distancing themselves from Lindstedt

Accused child molester Martin Lindstedt describes himself as a minister of the Church of the Sons of YHVH, but that group has expelled him from the ministerial ranks.
He, like Lindstedt, is an avowed racist.
Lindstedt, before changing his address to the Newton County Jail in Neosho had been a perennial candidate for every office from U. S. Senate to Granby Municipal Judge, losing every time out. He also has filed numerous lawsuits against everyone from Governor Matt Blunt to Missouri Southern State College to the Jasper County Sheriff's Department.

Lindstedt still pursuing Blunt lawsuit

Martin Lindstedt's residence is going to be the Newton County Jail for the foreseeable future, he faces felony statutory sodomy charges, he is serving 660 days in jail for contempt of court...but he is still making time to pursue his lawsuit against Missouri Governor Matt Blunt.
The lawsuit was tossed out last month by U. S. District Court Judge Richard E. Dorr, but Lindstedt filed a handwritten motion Friday asking that the suit be reinstated.
Referring to himself as "Pastor Martin "Mad Dog" Lindstedt, he complained about the "seven-cent golf pencil" he was having to use to file his motion and how Newton County officials will not provide him with law materials or copies or postage. Even worse, he says, he has no access to a computer. "Thus prisoner is at the mercy of this court regarding appealing its decisions, orders, and judgments."
In his motion, Lindstedt says the current statutory sodomy charge is "nothing more than third-hand hearsay," and that a therapist with the Missouri Division of Family Services had "managed to coax/coerce plaintiff's slightly retarded six-year old grandson after getting him alone after several months. On this fragile grounds, the probable cause affidavit claimed a lesser offense of first degree child molestation," but the statutory sodomy charge was filed, causing Lindstedt's bond to be set at $100,000
Lindstedt insists that he struck fear into the heart of Judge Greg Stremel and that Stremel panicked "when prisoner went before him to challenge the validity of the warrant."
He then talks about how his grandchildren were taken away from his stepdaughter and her two husbands (hey I'm just writing what he has on the motion) by claiming Lindstedt was an "alleged perpetrator."
Lindstedt says he convinced his "long-time domestic partner," Roxie Fausnaught to appeal the action to the Missouri Southern District Court of Appeals, which last week ruled against her. Lindstedt also casts aspersions against Stremel in his brief, which I will not go into in this post.
Lindstedt says he petitioned for a change of judge and asked for "anyone but Judge (Kevin) Selby." Stremel, seeing no reason to reward Lindstedt for his behavior in his court, naturally assigned Judge Selby to the case.
Judge Dorr will undoubtedly be happy to have to read page after page of the wrongs that have allegedly been committed against Lindstedt, how he gets his money ("perhaps prisoner can get a collection of Aryan Nations, Nazis, renegade Democrats to help pay for an appeal against this court and Runt Blunt," he writes), and other ramblings.
Finally, toward the end of the 10th and final page of his motion, Lindstedt gets around to the grounds for his appeal. "The genuine material facts are that defendant Blunt abuses his office as secretary of state/chief election official in 2002 to benefit Jim Talent and himself in 2004 by refusing to place Plaintiff's webpage under pretext of racism."
Lindstedt says he wants a trial and if Blunt is found guilty (highly unlikely since this is a civil case), have him removed from office. He is asking to be allowed to proceed as a pauper, meaning taxpayers would foot the bill for the appeal.
Lindstedt, as regular readers of The Turner Report are aware, has been a perennial losing candidate for public office, running for everything from U. S. Senator to East Newton R-6 Board of Education.
He notes on his petition that he "might be sent off any day now to the nuthouse for 'psychiatric evaluation' ordered by a county judge (Selby), an old enemy on June 30, 2005."

Tuesday, May 10, 2005

As I predicted in the April 29 Turner Report, perennial candidate (and perennial loser) Martin Lindstedt's federal lawsuit against Missouri Governor Matt Blunt was dismissed today.
Judge Richard E. Dorr dismissed the case with prejudice, in an opinion filed in U. S. District Court for the Western District of Missouri, meaning that Lindstedt cannot refile it.
Dorr had asked Lindstedt to show cause why the case should not be dismissed, since it appeared from the Granby man's previous filings that they were designed to harass and embarrass Blunt.
Lindstedt not only didn't show cause, but he demonstrated the judge's point. "Plaintiff's response states that (he) 'filed this lawsuit on July 21, 2004, to be just before the primary election so that it would be picked up by the news and entertainment media, and thus make Defendant Blunt an object of ridicule and contempt for his lawless and corrupt behavior.' "
In addition, Lindstedt said he planned to "do everything in my power to embarrass and humiliate" Blunt. For some reason, that gave the judge the idea that Lindstedt was trying to embarrass and humiliate Blunt.
Lindstedt's lawsuit was filed after Blunt, in his former position as secretary of state, refused to allow Lindstedt to be called Martin "Mad Dog" Lindstedt on the ballot. Lindstedt was running for governor in the same election and with the same party, Republican, that Blunt was running in. Lindstedt also sued because Blunt would not allow a link to be placed from the secretary of state's website to Lindstedt's website, something he had allowed other candidates to do.
Blunt said he did not allow the link because of racist and hateful doctrine on Lindstedt's website. The same kind of material found its way into Lindstedt's lawsuit as he wrote that he was fighting on behalf of the "Dual-Seedline-Christian Identity fighting faith and of White Nationalism, far better to simply wage revolutionary civil warfare against the Zionist Occupation Government and its masses of herd animals in order to bring this mighty evil empire, this Babylon, to its knees and chop off its head by means of violence and terrorism."
Then Lindstedt railed on about Latino immigrants and Muslims and said "whites (are) becoming second-class citizens in their own country."

I promise I am not going to harp on this forever, but this morning's Joplin Globe's sports section features about 15 column inches devoted to two Neosho High School wrestlers who have signed letters of intent to continue their wrestling careers at the collegiate level.
It has been nearly a week since 35 of the best high school students in southwest Missouri received four-year, full-ride scholarships to Missouri Southern State University and as far as I can tell, there has been no mention in The Globe of this.
The Globe may think it is meeting its academic quota when it runs its annual academic all-star team (while running football, baseball, boys basketball, girls basketball, volleyball, softball, and every other sport all-star team in the meantime), but even that annual ritual has been watered down over the years.
And if you check the Sunday Globe in which the academic team was unveiled, you will discover that the team photo was smaller than one that ran for an all-district sports team in the same issue.
How much of the Globe's readership area was affected by MSSU's Honors Signing? I haven't come up with a list of the actual students who signed the letters of intent last week, but MSSU's website ran a news release prior to the ceremony, saying that the following high schools would be represented at the signing:
Cassville, Carthage, Diamond, Galena, Glendale, Grove, Joplin, Lebanon, Lee's Summit, Liberal, Mansfield, Mount Vernon, Neosho, Nevada, Owasso, Ozark, Parkway West, Pea Ridge, Purdy, Santa Maria, Seneca, and Webb City.
Obviously, not all of those communities are in the Globe's circulation area, but many of them are and some of those schools had more than one student involved in the signing.
And despite the feel good news appearance of this story, there are some other news pegs the Globe (or any other news organization) could have used to add to the significance of the story.
It was not too long that these annual signing ceremonies featured as many as 60 students. Why are there so many fewer now? Does it have something to do with the cost of providing the scholarships?
And why are perfectly qualified area high school seniors being rejected for the full-ride scholarships while they are being given to students from Parkway West (a St. Louis school), Lee's Summit, and other out-of-the-area schools? Do these students have some local connection that the MSSU news release does not reveal?
I know of one area student who applied for the scholarship and has a sterling record during her high school years. She has always been a straight A student and a student leader in middle school and high school who was responsible for a drive that put more than 3,000 books into her school library. This supposedly fits in with the criteria the university has established for the program. So why is this young lady on the outside looking in, preparing to pay out a small fortune while students from outside the area are taking advantage of the program?
There may be simple answers to these questions. We won't know until some news organization actually takes the time to look for them.
***
On the same topic, the Sunday Neosho Daily News featured yet another giant photo in its sports section of a student signing, featuring the student, parents, coaches, high school principal, and a cashier at a local grocery store who wanted to get in on the action (just kidding about the last one).
There is a misconception that no one will read stories or look at pictures that concern academics. It's mainly because no one has really tried emphasizing them before. (I did to some extent at Carthage and Lamar, but I will be the first to tell you, I could have and should have done better.) Part of it, obviously, is it is easier to cover ballgames than it is to cover what goes on inside the classroom, but believe me there are enough events that are related to academics that it can be done.
The Carthage Press has shown that in recent weeks with its annual feature spotlighting the top 10 seniors of the graduating class, plus page-one coverage, story and photos, of induction ceremonies for the National Honor Society and the National Junior Honor Society.
The Press, under Ron Graber's astute leadership, has also placed a strong emphasis on other important extracurricular activities besides sports, giving prominent coverage to band, chorus, drama, and such academic-related activities as Odyssey of the Mind.
It can be done, all someone has to do is show the way.

Governor-Elect Matt Blunt is issuing an invitation to look at a website that offers racist comments and advocates overthrow of the government, but Missourians don't have any reason to be alarmed.
The invitation is part of a response to a lawsuit filed last summer by perennial losing candidate Martin Lindstedt of Granby. Lindstedt was upset because he was not allowed to have his name listed on the ballot as Martin "Mad Dog" Lindstedt during the gubernatorial primary in August.
He suggested that Blunt should have to run as "Runt' Blunt in November to pay for his alleged misdeeds.
According to Blunt's response to the lawsuit, filed Oct 8 in U. S. District Court for the Western District of Missouri, Lindstedt filed paperwork on March 10 to run for the Republican nomination for governor. He asked that his nickname, "Mad Dog" be listed on the ballot and that a link to his personal website, be posted along with links to other primary candidates' websites. Blunt turned down both requests.
After that. Lindstedt filed his lawsuit, not asking for the election to be overturned, but asking that Blunt be listed on the ballot and that a link to Lindstedt's lawsuit be included.
"Plaintiff's website is inundated with racism, anti-Semitism, profanity, and calls for open revolt against the government," Blunt's response says. "Plaintiff refers to himself as 'probably the most clever and ruthless of the Revolutionary Resistance political activists in Missouri,' and 'the only candidate...who is an overt White Nationalist,' as well as 'a genuine racist.' "
Blunt said that he could not quote any further from Lindstedt's website. "Respect for the decorum of this court makes it inappropriate for the secretary to extensively quote from (Lindstedt's) website." Nevertheless, Blunt invited the court to check it out for itself.
Blunt's attorneys, including attorney General Jay Nixon, claim that the federal court has no jurisdiction in the matter and that it is a moot point because the race is already over. "It is simply too late to change the ballots to effectuate (his) proposed remedy."
Blunt is asking for the court to dismiss the lawsuit.
In his reply, filed Oct. 26, Lindstedt points out that Springfield-area legislator Norma Champion, who once was host for a children's TV show called "The Children's Hour" under the name "Aunt Norma," was allowed to place that nickname on the ballot. Blunt's attorneys say that was not legal and it was done by his predecessor as secretary of state, Bekki Cook. Lindstedt said the claims made in Blunt's response are a "farrago of half-truths, outright lies and smarmy witless pleadings."
Lindstedt referred to Blunt as a "moral and mental flyweight." Lindstedt defended his racism, saying it "doesn't hold a candle to that of the Founding Fathers, especially George Washington, Thomas Jefferson, Patrick Henry, etal, who owned entire herds of negro slaves and never thought for an instant that such persons were anything other than property to be disposed of, much less being equal."
Lindstedt then claimed that the profanity on his site is nothing compared to that being played at full volume on radio speakers at a Joplin stoplight.
Lindstedt noted that Blunt was inviting the judges to look at a website that he "censored" from the public.

A proposed schedule for the Diamond R-4 School District's lawsuit against Edison Schools has been filed in U. S. District Court for the Western District of Missouri.
The filing, which was signed by attoney Paul N. Rechenber with Doster, Mickes, James, Ullon, LLC, Chesterfield, representing the school district, and Patrick Fanning with Lathrop and Gage, Kansas City, representing Edison, calls for an earliest trial date of Oct. 3, 2005.
If the proposed schedule is accepted by the judge, Dec. 17, 2004, will be the final date for changes in pleadings or the addition of any party to the suit.
Discovery will have to be completed by April 15 with a limit of 10 depositions and 25 interrogatories for each side.
No physical or mental examinations will be needed, according to the filing.
Expert witnesses for the school district must be submitted no later than May 10, 2005, with depositions for those expert witnesses submitted no later than May 31. Edison's expert witness list must be submitted by June 13 with depositions completed by July 11. The final date to refer the case to mediation is April 29.
Motions for summary judgment must be filed no later than Aug. 1.
The school district claims Edison owes it approximately $87,000 from the operation of summer school in 2002.

An interesting item on the Neosho Forums website at www.neoshoforums.com It appears that the Newton County Sheriff's Department has not updated its Internet list of sexual offenders since February 2001. That should make county residents feel safer.

While I sympathize with state officials who would prefer that school districts delay a lawsuit designed to address problems in the Foundation formula through which Missouri schools are funded, I fear letting the legislature handle the situation is just asking for trouble.
A number of southwest Missouri school districts, including Webb City, Carl Junction, East Newton, Diamond, Sarcoxie, Seneca, Jasper, and Westview, filed the lawsuit, hoping that the courts can handle a situation, which permits those school districts and others across the state to receive less money per pupil than others.
However, if you are going to make the funding fair, you would have to reduce the money going to some of the richer school districts and the legislators for those school districts are never going to allow that to happen. In the past, when the same situation occurred, the legislature ended up leaving the richer school districts with the funding they had and just pouring in more tax money to support the other districts.
That is probably what the General Assembly will suggest this time, which means the same situation will return in a few years. While I am a firm believer in our representative form of government, I am also a firm believer that we have few legislators who are willing to do what is actually best for everyone in the state. Maybe they will be if the threat of a court-ordered solution is hanging over them. So the last thing that should be done is to announce that the court case is on hold.

No big surprise here.
Perennial candidate and perennial loser Martin Lindstedt claims the statutory sodomy charges filed against him in Newton County Circuit Court are bogus and says that he is being railroaded.
In a motion filed in U. S. District Court for the Western District of Missouri today in an effort to get his lawsuit against Governor Matt Blunt reinstated, Lindstedt said his filing was handwritten because he was not given access to computers.
Lindstedt, a Granby resident, told the judge the story of how he came to be in captivity. "Plaintiff, since April 9, 2004, has had his four grandchildren taken from his long-time domestic partner's daughter. They lived across the street at 337 Rabbit Track Road. They were stolen by the Newton County Children's Division. After three months in captivity, a DFS therapist trained (my) small six-year-old grandson to claim (I) kissed him inappropriately."
Lindstedt said he and his partner have the case before the Missouri Court of Appeals in an effort to get their grandchildren back. "However, a Newton County deputy, on the basis of what this therapist told him (my) grandson said has had (me) arrested and is trying to railroad (me) for child molestation."
In the part of the document in which Lindstedt actually addressed his lawsuit against Blunt, Lindstedt makes no effort to curry the judge's favor in an effort to get him to reconsider his decision to dismiss the lawsuit.
"This court is biased in favor of defendant Blunt and it shows in every aspect of this case," Lindstedt said. He added that the judge had not addressed his complaint that Blunt had misused his position as secretary of state when he would not allow Lindstedt to be listed on the ballot with the nickname "Mad Dog" for the Republican gubernatorial primary in 2004. Plus, Lindstedt said, the judge never addressed Blunt's refusal to provide a link to Lindstedt's web site, something which was done for other candidates. Blunt's lawyers noted that Lindstedt's website was filled with hateful, racist messages.
"This court, in its absolute drive to let Defendant Blunt off the hook, has gone to elaborate rationalizations to get around the plain language of the Federal rules and case law.
Lindstedt attacked the judge's logic when the judge made the decision to remove Blunt as the defendant and replace him with Robin Carnahan since Blunt was no longer secretary of state. Carnahan, Lindstedt said, "cannot be lawfully a defendant as she has not abused her office against (my) civil and electoral interests and rights."
"This sock puppet charade is revealed for all to see," Lindstedt said. The Newton County Jail's best-known resident then continued to endear himself to the judge. "This court acts like the prostitute who discovers that men will pay for sex- that it has other purposes than procreation." He added that the judge is "making up the law as he goes along."
Continuing his apparent obsession with sexually-based remarks, Lindstedt said, "Yet Judge (Richard) Dorr acts like a squeamish virgin in his order of May 10 (which dismissed the case) whining that Plaintiff's sole basis for filing his original complaint so that on Day 21 after his April 19 order was to play politics and 'humiliate and embarrass Defendant Blunt.' Judge Dorr thinks he is the Republican Party's nanny, that he must protect his herd of Republican politicians."
As usual, Lindstedt's rant goes on for several pages, covering the same ground over and over. Las Vegas is not taking odds on Lindstedt's chances of getting his lawsuit reinstated.

Judge dismisses Lindstedt lawsuit against Obama

U. S. District Court Judge Howard F. Sachs dismissed white supremacist Martin Lindstedt's lawsuit against President Barack Obama today.

The particulars of Judge Sachs' decision were not available since all documents filed in the U S. District Court for the Western District of Missouri in the case, with the exception of the docket, have been kept from public view.

However, Lindstedt posted the text of the lawsuit, most of which is incomprehensible ramblings, on a website. In the complaint, Lindstedt, serving as his own lawyer, writes, "The main reason that Plaintiffs are filing this lawsuit is simply that it goes against Plaintiffs' religious beliefs to allow any non-white, especially a n-----, to be in any position of authority over any White man, no matter how degraded." (Note: Lindstedt's lawsuit uses the actual n word. I don't intend to do the same.)

Lindstedt refers to himself in the lawsuit as pastor of The Church of Jesus Christ Christian/Aryan Nations of Missouri. Other defendants in the action include Sen. John McCain, the State of Missouri, Gov. Matt Blunt (the suit was filed in November), Missouri Department of Mental Health/Fulton State Hospital, Attorney General Jay Nixon, Secretary of State Robin Carnahan, Missouri Supreme Court, Missouri Democratic Party, Missouri Republican Party, Missouri Libertarian Party, "Traitor" Glenn Miller, Newton County Republican Party, Newton County Sheriff Ken Copeland, Judge John LePage, Assistant Prosecuting Attorney Jakob Skouby, and Newton County Clerk Kay Baum.

The lawsuit includes this sentence:

"We could, like other White Nationalist organizations, simply hope and pray for an assassin and enjoy the inevitable race riots which we seek."

Lindstedt has previously filed frivolous lawsuits against everyone from Missouri Southern State University, the city of Granby, Matt Blunt, well, you name it, he's sued it. He has also been an unsuccessful candidate for every political position from East Newton R-6 Board of Education to governor.

At the time the lawsuit was filed, Lindstedt faced a statutory sodomy charge in Newton County Circuit Court. That charge has since been dismissed.

Lindstedt: Saddam more honest than Matt Blunt

First, consider the source.
Yes, perennial candidate, avowed racist, and current Newton County prisoner Martin Lindstedt is whiling away the hours with more motions in his dead court case against Missouri Governor Matt Blunt.
The case was dismissed by U. S. District Court Judge earlier this year. Last month, Dorr ruled against Lindstedt's motion to file an appeal at the taxpayers' expense. Now, in documents filed today in U. S. District Court for the Western District of Missouri, Lindstedt is trying again, saying he was misunderstood and he will foot the bill for his court case if the court will instruct Newton County Sheriff Ken Copeland "to let plaintiff as a prisoner go to his bank or out in the field to dig up some money not buried with his guns."
After that request, Lindstedt writes, "Now for a page or two chewing on this federal district court's ass:" Now if that's not a method of winning friends and influencing people, I don't know what is.
Lindstedt goes over the basis of his lawsuit against Blunt: Blunt did not allow Lindstedt to put his nickname "Mad Dog" on the ballot when Lindstedt was a candidate for the Republican nomination for governor in 2004. Blunt also refused to post a link to Lindstedt's website on the secretary of state's website (Blunt held that position and was also running for governor on the GOP ballot at that time) claiming (accurately) that the website was racist and filled with hate.
Lindstedt writes, "Plaintiff has been open and honest in his motivations for suing Defendant Blunt. Plaintiff knows Defendant Blunt is a moronic politician for sale to corporate bidders." He later claims that Blunt stole his office by deceit and bought it at auction.
He then says, "Saddam Hussein ran a far more honest campaign." Blunt then compares Iraqi "freedom fighters" to American soldiers saying "the average Iraqi freedom fighter, so-called insurgent terrorist, is far more of a man than the average ZOGling herd animal."
And Lindstedt can't figure out why no one takes him seriously.
Lindstedt also gives an update on his time in the Newton County Jail. "Plaintiff as a professional prisoner eats everything on his plate, no matter how loathsome and is now in fighting trim."
Lindstedt is charged with felony statutory sodomy and is being held in lieu of $100,000 bond. Newton County Circuit Court Judge Kevin Selby also sentenced him to 660 days on 22 counts of contempt of court. Selby has ordered a mental evaluation for Lindstedt.

I read with interest today's Neosho Daily News article on the arraignment of self-proclaimed bigot and perennial candidate Martin Lindstedt on statutory sodomy charges.
John Ford's well-written article notes that the Southern Poverty Law Center notes that Lindstedt advocated death for "corrupt politicians and lawyers." I can also recall during that campaign that Lindstedt made threats against elected officials, threats that were reported in only one source at that time, a Carthage Press article that I wrote.
Because of his many lawsuits and ludicrous behavior, it is easy to think of Martin Lindstedt as being just a joke. And while that description fits him, the most recent charge, coupled with his bigotry and threats make him far more than just an annoyance.
I can remember at that time, receiving a couple of phone calls from politicians who were disturbed that I was publicizing Lindstedt's ravings. Perhaps if some others had jumped on the bandwagon at that time and Lindstedt's actions had been thoroughly examined, maybe the incident or incidents that sparked this arrest may never have occurred.
The Daily News also mentions the lawsuit Lindstedt filed against Missouri Governor Matt Blunt last year. That lawsuit has been dismissed with prejudice as of two days ago. Ford's article has the most complete rundown of Lindstedt's various lawsuits that I have seen.

Pre-trial conference set for Lindstedt

Nearly three years have passed since perennial candidate Martin Lindstedt was arrested in Newton County for statutory sodomy. If things go as planned, and nothing has in Lindstedt's case, a pre-trial hearing will be held 10:30 a.m. Tuesday before Judge John LePage in Newton County Circuit Court.
Lindstedt's case has been delayed while he underwent psychological evaluations and has already gone through four judges.

Lindstedt has run for every office from East Newton R-6 Board of Education to U. S. Senator, and has also filed numerous lawsuits, including ones against several of the judges who have been involved in this case, the Missouri Department of Mental Health, the Missouri Southern State College Board of Regents, the Jasper County Sheriff's Department, and most famously, against Governor Matt Blunt.

It was only two years ago that Lindstedt's lawsuit against the governor was rejected by a federal judge.

Judge Dorr kicks Lindstedt lawsuit again

Accused child molester Martin Lindstedt lost again in federal court today.
For the umpteenth time, U. S. District Court Judge Richard Dorr said no to Lindstedt's lawsuit against Missouri Governor Matt Blunt. Lindstedt's motion for reconsideration "raises no new arguments or legal theories which have not been or could not have been raised at an earlier time," Dorr wrote. "Moreover, the motion does not introduce new evidence."
Dorr was far kinder considering the waste of time and money Lindstedt has been to the taxpayers. The perennial candidate, who has run for every office from U. S. Senator to dogcatcher, is currently staying in the Newton County Jail awaiting trial on felony statutory sodomy charges. Newton County Circuit Court Judge Kevin Selby also slapped him with 660 days in jail for contempt of court.
All through this, the avowed racist and alleged minister has continued his quixotic lawsuit against Blunt, whom he claims wrongfully kept him from using his nickname Martin "Mad Dog" Lindstedt on the ballot when he ran for the Republican nomination for governor in 2004. Blunt was Missouri secretary of state and was also running for the Republican gubernatorial nomination at the time. Lindstedt also said Blunt violated his rights when he refused to put a link to Lindstedt's garbage-filled website (a site which features one hateful, racist comment after another) on the Missouri secretary of state's website.
When he initially filed his lawsuit, Lindstedt asked that Blunt be forced to use the nickname Matt "Runt" Blunt on the November 2004 ballot. For some reason, the judge did not go along with this idea.
After Lindstedt's initial lawsuit was tossed out, he has tried multiple times to get the judge to overturn the decision, but he has not been exactly the sole of discretion in his efforts nor has he remained peaceful during his all-expenses paid stay in Newton County facilities.
In a letter last month to Neosho Forums, www.neoshoforums.com, Lindstedt said the actions taken against him by Newton County officials have made the county "a prime target for biological warfare."He also says, ".Â… "I don't build bombs. I build bombers. Not just one or two bombers. And not armed with just one little truck bomb. I build bombers who know how to make their own biological weaponry and who do not get caught."

Blunt, Carnahan beware- white supremacist Lindstedt plans Senate bid

As if Chuck Purgason wasn't enough for Roy Blunt to deal with, a new candidate is about to jump into the GOP primary for the U. S. Senate seat currently held by Kit Bond.

White supremacist Martin Lindstedt, Granby, announced his plans in a filing in U. S. District Court for the Western District of Missouri in his attempt to have his lawsuit against President Barack Obama reinstated and that it be "brought to trial by jury, preferably all whites."

Lindstedt said he would run for Senate in 2010 "if alive and even if jailed."

In the lawsuit, Lindstedt somehow sees a connection between the fact that Obama, a black man can run for president, but that he, Lindstedt, was tossed in jail for statutory sodomy and was not able to mount a candidacy for governor and sheriff. The judge requested that Lindstedt make his motion understandable and not a long, rambling statement. Here is how that worked out:

Can a non-white be allowed to run for public office while at the same time a White Christian can, under sundry pretexts, be denied his Constitutional right to run for Governor and for Sheriff? The way things are set up, it really doesn’t matter whether Plaintiff Lindstedt and his political organs even were unlawfully imprisoned or not. The way things are set up, thanks probably to a federal agent provocateur named ‘TraitorGlenn Miller’ no openly White Christian Man can run on a political party with ballot access. Couple that with the fact that many and most of the Defendants had Plaintiff Lindstedt unlawfully imprisoned without trial or habeas corpus or affordable bail although not a flight risk, were unlawfully doping him up as happened during the worst days of the former Soviet Union, and that all or most of the Defendants benefitted from this treasonous tyranny, then any complaint which sets these matters down may well be “overly long and rambling.”

Lindstedt does not explain why his court filings in his various lawsuits before he was allegedly doped up were also long and rambling.

Lindstedt, aligning himself with such Missouri stalwarts as Rep Cynthia Davis, R-O'Fallon, and possibly even his potential opponent in the 2010 primary, Roy Blunt, by expressing his belief in the birther notion that OBama is not a United States citizen:

"This Court by dismissing the lawsuit against Defendants who have not even bothered to make an answer, especially the lead thieving fraudulent n----- alleged president who isn’t even a citizen of the United States isn’t even bothering to play by the Federal Rules of Civil Procedure. C’mon, make them give an answer of some kind or sort before you turn them all loose to commit election treason again. "

Lindstedt continues:

"This Court has the power – if it chooses to use it – to question whether it is lawful to allow non-whites to run for the highest public office in the land while on the other hand allowing White Christian heterosexual men to not be allowed to run for state and local office precisely because they are openly and unapologetically pro-White and pro-Christian."

Lindstedt adds, "Essentially now us White Men are on the bottom and slated for slavery and extermination and we sure as hell don’t like it."

Then in a section entitled "So What Are You Going to Do About It?", Lindstedt notes that many of his fellow white supremacists have been put behind bars recently:

Given that quite a few of my White Nationalist colleagues like Hal Turner and Pastor Robert Joos, and the not much liked or respected Bill White/Weiss and Hardy Mongrol-Lloyd are in jail on trumped-up charges for running their mouths and thinking that the CONstipation and Bill of Goods was going to protect them, and an acquaintance James Von Brunn (Note: Von Brunn is the man who murdered a guard at the Holocaust Museum) the only one who got his licks in precisely because he kept his mouth shut, Plaintiffs are certainly not going to make any threats. However, this decision to essentially disenfranchise White people from being able to peacefully run for public office openly as White Nationalists will have consequences.

Friday, April 29, 2005

I am going to go out on a limb and predict that perennial candidate Martin Lindstedt's lawsuit against Missouri Governor Matt Blunt will soon be thrown out of federal court.
Judge Richard Dorr already threatened to throw it out, giving Lindstedt 20 days to show case why the case should not be dismissed.
"Plaintiff is tickled pink to do so," Lindstedt said in documents filed today in U. S. District Court for the Western District of Missouri.
Lindstedt seemed more than slightly irritated that Judge Dorr removed Blunt as a defendant and replaced him with current Missouri Secretary of State Robin Carnahan. Lindstedt had sued Blunt because he would not allow Lindstedt's nickname, "Mad Dog," to be placed on the gubernatorial primary ballot, and because he would not put a link to Lindstedt website on the state elections webpage.
Lindstedt probably did not curry the court's favor when he repeated a phrase he used in a Nov. 29, 2004, filing in which he said Blunt and his counsel Assistant Attorney General Trevor Bossert "had already screwed the syphilitic whore called Democracy and that they wanted this federal court to have sloppy thirds."
Lindstedt accused Judge Dorr of taking sides and said Dorr had "anointed Blunt's cause with an unholy mixture of judicial Crisco oil and Jergens Lotion.
Racist doctrine found its way into Lindstedt's lawsuit as he wrote that he was fighting on behalf of the "Dual-Seedline-Christian Identity fighting faith and of White Nationalism, far better to simply wage revolutionary civil warfare against the Zionist Occupation Government and its masses of herd animals in order to bring this mighty evil empire, this Babylon, to its knees and chop off its head by means of violence and terrorism."
The Lindstedt railed on about Latino immigrants and Muslims and said "whites (are) becoming second-class citizens in their own country.
Lindstedt asked Judge Dorr to remove Governor Blunt from office, and to replaced him with either State Auditor Claire McCaskill or former Governor Bob Holden.

Lindstedt pays filing fee under protest

Perennial candidate and loser Martin Lindstedt, currently in the Newton County Jail awaiting trial on felony statutory sodomy charges, paid the $255 filing fee for the appeal of his federal lawsuit against Missouri Governor Matt Blunt. The information was filed Friday in U. S. District Court for the Western District of Missouri.
In his rambling, four-page description of his adventures, Lindstedt continues to maintain his innocence on the local charges and indicates he is conducting guerrilla warfare on his jailers. "I have vowed to torture and destroy the spawn of regime criminals," he wrote. "Consequently, I am in solitary confinement."
Lindstedt sued Blunt for actions Blunt took while he was secretary of state and Lindstedt was running against him in the Republican primary for governor. Blunt refused to allow Lindstedt to use his nickname, "Mad Dog" on the ballot, and refused to provide a link to Lindstedt's website because of its racist content, while providing links to other candidates' websites.
"If Appellant (Lindstedt) is correct," he wrote, "then Defendant Blunt must be removed on the basis of corrupt election from the current office of governor of Missouri by which himself and a corrupt corporate cabal conspired to have (him) enthroned."
Lindstedt says Blunt is "less legitimate than Saddam Hussein as president of Iraq, but rather than have a regime change of regime criminal by means of invasion, artillery, and civil warfare, Appellant proposes to give this federal regime a chance to take out its trash and remove the more idiotic of its regime criminals."
Lindstedt indicates he hopes his $255 filing fee is reimbursed by "patriots and Al Qaeda."
Lindstedt's lawsuit and his first attempt to appeal the decision were rejected by Federal Judge Richard E. Dorr.

Judge rejects Lindstedt attempt to revive Obama lawsuit, but leaves opening for new filing

Federal Judge Howard Sachs rejected white supremacist Martin Lindstedt's attempt to have his lawsuit against President Barack Obama reinstated today.

Sachs left a small opening for Lindstedt to proceed, allowing Lindstedt 30 days to file another motion to reopen the case, but the judge set the bar high. The motion has to be "completed in short and plain language," the judge said, an obvious reference to Lindstedt's penchant for long, rambling dissertations, liberally sprinkled with racist language.

The following description of the lawsuit was offered in the June 23 Turner Report.

The lawsuit, broken down into simple terms, was filed because an African American was elected president and Lindstedt was unhappy about it.
U. S. District Court Judge Howard F. Sachs dismissed the case June 17.
The particulars of Judge Sachs' decision were not available since all documents filed in the U S. District Court for the Western District of Missouri in the case, with the exception of the docket, have been kept from public view.

However, Lindstedt posted the text of the lawsuit, most of which was incomprehensible ramblings, on a website. In the complaint, Lindstedt, serving as his own lawyer, wrote, "The main reason that Plaintiffs are filing this lawsuit is simply that it goes against Plaintiffs' religious beliefs to allow any non-white, especially a n-----, to be in any position of authority over any White man, no matter how degraded." (Note: Lindstedt's lawsuit uses the actual n word. I don't intend to do the same.)

Lindstedt refers to himself in the lawsuit as pastor of The Church of Jesus Christ Christian/Aryan Nations of Missouri. Other defendants in the action included Sen.

Obama served with Lindstedt lawsuit

Federal court records indicate President Barack Obama was served Friday with a lawsuit filed by white supremacist Martin Lindstedt of Granby...a lawsuit in which Lindstedt indicates he would not mind seeing the president assassinated.

Lindstedt's complaint is apparently closed to the public since the message "You do not have permission to view this document" is shown when the link on the U. S. District Court for the Western District of Missouri website is clicked.

However, Lindstedt posted the text of the lawsuit, most of which is incomprehensible ramblings, on a website. In the complaint, Lindstedt, serving as his own lawyer, writes, "The main reason that Plaintiffs are filing this lawsuit is simply that it goes against Plaintiffs religious beliefs to allow any non-white, especially a n-----, to be in any position of authority over any White man, no matter how degraded." (Note: Lindstedt's lawsuit uses the actual n word.

Sadly, the cost of serving President Obama, John McCain (who was also served Friday, according to court records), and the other defendants, as well as the bill for this waste of time, is being borne by taxpayers.

Lindstedt has previously filed frivolous lawsuits against everyone from Missouri Southern State University, the city of Granby, Matt Blunt, well, you name it, he's sued it. He has also been an unsuccessful candidate for every political position from East Newton R-6 Board of Education to governor.

Lindstedt, by the way, is still awaiting trial on a charge of statutory sodomy. He allegedly molested a six-year-old boy. He is free on bond.
