Freeman Health, Oklahoma woman settle malpractice/negligence lawsuit


A settlement has been reached in a malpractice lawsuit filed against Freeman Health by an Oklahoma woman who claims that actions taken by a doctor while trying to repair her hiatal hernia perforated her stomach.

A notice of dismissal with prejudice was filed today in U. S. District Court for the Western District of Missouri by Johanna Berryman indicating the settlement had been reached and no details will be made available.







According to the petition, Berryman's surgery, performed by Dr. David A. Baker, also a defendant in the lawsuit, took place October 15, 2019. Two days later, she returned to the hospital with pain and vomiting. I-rays did not reveal any cause, but "a computerized tomography (CT) scan was ordered and confirmed a ten (10) by eight (8) centimeter abnormal fluid/contrast and air collection along the lesser curvature of the stomach."

An upper gastrointestinal endoscopy revealed the perforation.

Berryman was represented by Daniel C. Mizell of Deputy & Mizell, LLC, Camdenton.
