A Joplin man trying to avoid being arrested for driving while intoxicated led a Missouri State Highway Patrol trooper on a pursuit at speeds reaching 108 miles per hour November 18 according to a probable cause statement filed today in McDonald County Circuit Court.
A warrant was issued for Daugherty's arrest Wednesday.
The DWI arrest for Daugherty was his fourth, the probable cause statement said. The Neosho Police Department arrested him for DWI in 2015 and 2016 and he pleaded guilty to both charges. The Highway Patrol arrested him in 2019 and he was found guilty on that charge as well.
From the probable cause statement:
I asked Daugherty how much he had to drink and he stated, "A lot."
I performed Horizontal Gaze Nystagmus test on Daugherty and observed all six clues of impairment. I observed Daugherty's eyes to be bloodshot and watery. I asked Daugherty if he would blow on a Preliminary Breath Tester and he agreed to take the test.
The results of the PBT test was a blood alcohol concentration of 0.230%.
