According to the probable cause statement filed in Newton County Circuit Court, Richard Wayne Olbrey (DOB 1979) was arrested following a traffic stop June 29.
From the probable cause statement:
I turned around to follow the UTV. I then saw it was missing a taillamp. The UTV turned south on Hottel Springs road. As I was following the UTV it traveled into the northbound lane multiple times. I activated my emergency equipment. The driver took an abnormal amount of time to pull over.
I contacted the driver and explained the reason for the stop. I asked the driver about not stopping. He told me he did not hear my siren. I requested the driver provide me with his license. The driver attempted to hand me his credit card. I explained I needed his license not his credit card.
The driver was identified as Richard W. Olbrey. I could smell a strong odor of Intoxicants emitting from his breath and his speech was slurred. I asked Olbrey how much he had to drink tonight. Olbrey stated "more than enough."
I noticed multiple empty beer cans in the floorboard. I went to my patrol vehicle and checked his information. I returned and requested Olbrey step out of the UTV to conduct field sobriety tests. Olbrey complied and stepped out.
I returned to my patrol vehicle and shut off my spotlight. As I was walking back Olbrey told me If I was going to take him in just go ahead and take him. I explained I would like to do the field sobriety tests. Olbrey complied.
I requested Olbrey complete the following sobriety test. a. Horizontal Gaze Nystagmus: I explained and administered the Horizontal Gaze Nystagmus Test. Before starting the test I saw Olbrey's eyes were blood shot and watery. I observed a lack of smooth pursuit in both eyes as well as distinct and sustained nystagmus at maximum deviation. Olbrey's eyes also showed and onset of nystagmus prior to 45 degrees.
Walk and Turn- I explained and demonstrated the starting position and requested Olbrey to stay in this position while I finished my Instructions. Olbrey indicated he understood by stating "Yup."
Olbrey took the wrong number of steps going down and back. He failed to touch heel-to-toe, stepped offline, and stopped while walking. The last test I conducted was a preliminary breath test. I visually checked his mouth and confirmed he did not have anything in it. Olbrey provided a sample of .214%
Olbrey's previous DWI convictions were detailed in the complaint:
1. On or about September 25, 1997, defendant was found guilty of driving while intoxicated for events
occurring on July 11, 1997, in Neosho Municipal Court, and
2. On or about February 22, 2001, defendant was found guilty of driving while intoxicated for events
occurring on October 8, 2000, in Neosho Municipal Court, and
3. On or about June 15, 2005, defendant was found guilty of driving while intoxicated for events
occurring on April 15, 2005, in the Circuit Court of Newton County, and
4. On or about April 2, 2009, defendant was found guilty of driving while intoxicated for events
occurring on February 22, 2009, in Anderson Municipal Court

Another failure of our Legal System - when our Worthless Judges and Prosecutors continue to allow Criminals like, Richard Wayne Olbrey, to continue there Bad Behavior year after year - Four, Five, Six, Seven or more DWI 's and these are just the ones these Drunk Drivers have been caught doing - What is it going to take - for the Jasper, Newton, McDonald Counties Worthless Judges and Prosecutors to wake up and DO YOUR DAMN JOBS - and Lock these Criminals Up - Do they need to Kill Someone before you IDIOTS take Notice???????
Wow! You are an angry person. This person is a human being that has an addiction. If you knew him you would no that he is a good person with an unfortunate addiction. Not to mention that he went 16 years between this DUI and the last one. I’m not making excuses and saying it’s right, just pointing out he is a person with an illness.
7:37PM - If this guy with his fifth DWI (and you know this is just what he has been caught doing - what about all the times he wasn't caught) kills your family or friends, will you be angry then - So he can use that excuse when he Kills someone - "I have an Illness" - STOP THE BS AND THE PITTY PARTY - He is an Adult - Stop making Excuses for People that Break the Law - - SO YES I AM ANGRY THAT CRIMINALS GET AWAY WITH THIS - WHEN THEY COULD KILL AN INNOCENT CHILD OR FAMILY - BECAUSE OF THEIR LACK OF USING GOOD JUDGEMENT.
Pretty sure he hasn’t gotten away with this. Go be angry somewhere else. All I’m saying is that we don’t need to lock everyone up. We need to find ways to help those with an illness. By the way, he wasn’t driving a car on the highway, he was in a side by side probably checking cows.

Truth of the matter is, I personally have known him my entire life. I am not a close friend, I just know he has an addiction and that is an illness. As far as your personal attacks, I could care less. I’m sure your MAGA loving #*= lives off government assistance and you use your disability check to buy ammo and donate to Trump. My argument was never political. Just praying for the best for a person I know to be a good guy. Who has an addiction.

Just because it's been 16 years since he was last caught does NOT mean that he doesn't still drink and drive on a regular basis. Does he need to kill someone before he loses the privelage? Being an addict is no privilege?
