Joplin R-8 attorney subpoenas information on relations between union, P1 Group

Subpoenas issued to the PI Group, the Lenexa, Kansas, electrical contractor, which the Joplin R-8 School District is suing for shoddy work on Joplin High School, seek to find out what effect the union had on the $6 million in charges the firm says the district owes it for overtime and extra costs.

The district filed the lawsuit when it learned that the PI Group was preparing to sue for money it had not been paid. Since then, the contracting firm has filed a countersuit, claiming that the overtime and extra costs came as a result of former Superintendent C. J. Huff's unsuccessful push to open school on time in August 2014.

According to the subpoenas, the P1 Group must submit the following documents to the Kansas City offices of the R-8 District's attorneys, the Polsinelli Group, by Friday, March 18.

The subpoena demands production of the following items:

All documents and records consisting of or reflecting communications (including electronic mail) between IBEW Local 226 and any other person or entity concerning or relating to the project, including, without limitation, all correspondence and communications between or among representatives or members of IBEW Local 226 and representatives of P1 Group, UCC, Corner Greer Associates, Inc., or Smith & Boucher, Inc.

All documents and records consisting of or reflecting internal communications (including electronic mail) of IBEW Local 226 or its members concerning or relating to the project.

All notes, memoranda and other forms of recordation (whether written, printed, typed, recorded, transcribed, or otherwise preserved in any form, concerning or relating to the project.

All contracts and agreements, including any addenda, entered between IBEW Local 226 and and P1 Group in relation to the project.

All documents and records reflecting work, services, or labor furnished for the project by members of IBEW Local 226, including all work logs, timesheets, diaries, field reports, and notes.

All documents and records concerning or reflecting delays experienced by members of IBEW Local 226 on the project, or in the performance of work, services, or labor for the project.

All documents and records concerning or reflecting an increase in labor rates for workers performing work, services or labor for the project.
