De La Pena was booked into the Greene County Jail Sunday, following a Carthage Police Department traffic stop on West Fairview Avenue for failing to use a turn signal.
The Carthage Police Department issued the following statement to KOAM:
"De La Pena Ochoa presented a Guatemalan passport as identification. He was issued a warning for the turn signal violation and taken into custody for operating a motor vehicle without a valid driver’s license, so that fingerprints could be obtained to verify his identity. De La Pena Ochoa was transported to the Jasper County Jail and released to jail staff."

KOAM followed up with the Department of Homeland Security, which issued the following statement:
Frank de la Pena is a CRIMINAL illegal alien with a rap sheet that includes 3rd degree assault, resisting arrest, and driving without a license. He was not 'kidnapped,' he was arrested for BREAKING the law.
An immigration judge issued this criminal illegal alien a final order of removal in 2002. His appeal was dismissed. On August 9, he was arrested by local police for driving without a license. On August 11, he was turned over to ICE.
Under President Trump and Secretary Noem, if you break the law, you will face the consequences. Criminal illegal aliens are not welcome in the U.S.
Sylvia Lindsey, De La Pena's daughter, has organized a Go Fund Me fundraising campaign which at 10 p.m. Wednesday had raised $3,300 from 75 donors.
The page features the following message:

My family will be needing to obtain a lawyer and pay for paperwork expenses going forward. He is not a criminal and does not have a criminal record; he was simply a young boy when he arrived here. Any help to get my dad and my sons' Peepaw home is greatly appreciated!

There's ways to be in the country legally. If he's failed to go the proper way and is a criminal then he needs to go. Doesn't matter if he worships god the law is the law and he should know better and anyone that donates to this is as stupid as he is. Theres a reason we have laws

Likely had no insurance and if he did it’s likely void because he has no license. I’ve been hit 3 times by drivers with no license and nothing is done to them, but I have to take the insurance hit because they are not responsible people.

Does any of this make him a bad person, it’s a matter of opinion.
If all was done in his past and he’s paid the price for it so be it. But he’s got to be held accountable, I can’t sneak into another country and not expect this to happen to me.
