Smith's attorney asks for second hearing on motion to dismiss Isle of Capri case
Sen. Jeff Smith's lawyer has filed a motion in Cooper County Circuit Court asking for a rehearing of his motion to dismiss the case. The trial of Smith, a St. Louis Democrat, is scheduled for 2:30 p.m. Tuesday, Feb. 26.
Smith's initial motion to dismiss was overruled Jan. 25 by Judge Keith Michael Bail.
Smith is charged with presenting false identification in order to gamble at the Isle of Capri casino in Boonville during a lobbyist-financed junket on July 31. At the suggestion of lobbyists Lynne Schlosser, he purportedly used the identification of Rep. Joe Aull, D-Kansas City to gamble.
