A class action lawsuit against Joplin-based Vintage Stock alleging unsolicited robotext messages should be dismissed because the plaintiff had given the company "prior written consent to receive the messages," according to a motion filed today in U. S. District Court for the Western District of Missouri.
Chad Stapleton, an Oklahoma City resident, claimed he never gave permission to Vintage Stock to send th the messages and that the messages violated the Oklahoma Telephone Solicitation Act of 2022.
The lawsuit also asked for a class action designation.
In the motion filed today, Vintage Stock's attorneys asked that if the court allows the lawsuit to continue that the class action designation be dismissed.
