Joplin woman, cocaine, meth user, sentenced to 19 years in prison on weapons charge

A Joplin, Mo., woman was sentenced in federal court today for illegally possessing a firearm.

Tracy Arlene Smith, 48, was sentenced by U.S. District Judge M. Douglas Harpool to 19 years and seven months in federal prison without parole.

On Sept. 25, 2018, Smith was found guilty at trial of one count of being a felon and an unlawful user of cocaine and methamphetamine in possession of a firearm and ammunition.

According to evidence introduced during the trial, law enforcement officers executed a search warrant at Smith’s residence located in Joplin, on June 22, 2017. During the execution of the search warrant, members of the Ozark Drug Enforcement Team seized Smith’s purse, which contained a CDM Prod. Inc., .22-caliber pistol, loaded with six rounds of .22 caliber ammunition. Officers also seized drug paraphernalia.








Under federal law, it is illegal for anyone who is an unlawful user of controlled substances, or who has been convicted of a felony, to be in possession of any firearm or ammunition. Smith, who was on parole at the time she committed the offense, has five prior felony convictions for forgery, four prior felony convictions for possession of a controlled substance, and prior felony convictions for sale of a controlled substance (on three separate occasions) and assault.

This case was prosecuted by Supervisory Assistant U.S. Attorney Randall D. Eggert and Assistant U.S. Attorney Nhan D. Nguyen. It was investigated by the Ozark Drug Enforcement Team and the Bureau of Alcohol, Tobacco, Firearms and Explosives.

Yes its a little excessive ...
Unfortunately and i hate to sayit it but it's ak own fact that if she were a caucasan lady she wouldn't of got 19 years . She would gotton drug rehab and maybe a couple years... Does she need some time? Absutely! . but 19 years absolutely not. This state and this judge are nknown to let caucasian child predators off with less time . Its sad .

If this had been Caucasian lady oh, she would have been offered all the help in the world to get herself together. What's a lighter sentence. Unfortunately we see this happened each and every day the injustice. This is very disturbing and sad.

Men get 20-25 years for the same thibg. Just cause she is a female she shouldn't get a lesser sentence. It has nothing to do with color, she has a very long history as a repeat felony offender.
It is still very sad that her life is wasted.

Know the facts and do some research before you bring up race. As a minority, the race card in this case dilutes any race argument. Tracy had her chances, and had been through programs and had been in state prison before. The sentences do not get shorter when it is the 3rd or 4th conviction. This was a federal charge. The only person that should feel like her life was wasted is the multiple convicted felon. As a grandparent, I am glad this person is not on the street.

And to 11:42, Starting a revolution behind someone like her only makes a cause worthless.

Unjust and unfair federal drug laws ruin peoples lives and Im sure ive seen just as many white people get more time. I just had a friend get 25 yrs for the same thing .. Unlawful user who voted for that law ???? The constitution of the united states says we have the right to bare arms
.. It doesnt say unless and or if after that

addiction, drugs, violence - these things aren't racist, sexist, agist. addiction doesn't care if you're black or brown or white or some sort of halfsie. addiction doesn't care if you're a successful, rich, powerful CEO, or if you're an innocent, naive, young mormon girl. and you know what? all the terrible shit you do when you get involved with drugs and addiction - it doesn't give an eff, either. and when you gotta face your consequences? race, age, religion, orientation, height and weight, favorite snack - also doesn't matter. Nothing about this is unjust or unwarranted. You get what you give; karma isn't bias, either.
