The Newton County Prosecuting Attorney's office filed second degree murder and drug trafficking charges against a Neosho couple in connection with the November 28 death of a man due to a fentanyl and methamphetamine overdose.
Arrest warrants were issued for Madison Shaye Stonecipher (DOB 2000) and Gatlin McKell Pennington (DOB 1993) with no bond for either of them.
From the probable cause statement:
Victim#1 was reported missing on 11/29/2024. Victim#1`s body was located on 12/01/2024 near some railroad tracks in Neosho, MO. Victim#1 was found to be deceased with two syringes clinched in his hand.An Autopsy was conducted on Victim#1 on 12/02/2024 and the medical examiner ruled the cause of death to be from a fentanyl and methamphetamine overdose.
Victim#1`s phone was recovered from his body and a cell phone data extraction was conducted. The extraction contained Facebook Messenger records that showed conversations between Victim#1`s account and Gatlin Pennington's account.
The messages show Victim#1 attempting to trade a Cricut machine to Pennington for 3/10th`s of a gram of fentanyl. The Drug Enforcement Administration (DEA) considers two miligrams of fentanyl to be a potential lethal dose.
The messages were between the dates of 11/26/2024 13:46 and 11/28/2024 00:59. The messages between the two stop after that time.
Between the dates of 11/14/2024 16:18 and 11/27/2024 22:04 Victim#1`s Facebook messenger account is shown to be messaging with Madison Shaye Stonecipher's account. The messages show several times where Victim#1 agrees to meet and pay Stonecipher for fentanyl.
On 11/24/2024 Victim#1 messages Stonecipher asking if she wishes to trade fentanyl for a Cricut machine. A recorded phone call made on 11/29/2024 was provided to this Detective that Victim#1`s girlfriend had in her possession. The phone call is between Victim#1`s mother, and Pennington`s girlfriend Madison Stonecipher.
In the phone call confronts Stonecipher about trading heroin for a Cricut machine. Madison does not deny trading heroin to Victim#1 and stated that she and Pennington met Victim#1 near to get a Cricut machine from him around 01:00 on 11/28/2024. Pennington was taken into custody by Joplin Police Department on 12/02/2024 for possessing 13 grams of fentanyl at the time.
During an interview while under Miranda, Pennington gave full consent to FBI TFO D. Moyer to download the content of his cell phone. Text messages between Stonecipher and Pennington were as follows: 11/29/2024 Stonecipher sends- "You have to click unsend for everyone on every single message you sent him. Do each one separately. Don`t just delete all of them."
12/01/2024 Stonecipher sends- "Jesse is dead. I deleted my Facebook. Like permanently. You might wanna do the same. I need you to get a hold of those insurance people like quick. So we can go."
On 12/17/2024 FBI TFO Moyer and I interviewed Pennington at the Jasper County Jail under Miranda. Pennington stated that he had been selling fentanyl to people that was laced with Xylazine. Pennington stated that he was aware that Xylazine can kill you and that Narcan cannot reverse the effects of Xylazine.
Pennington stated that it`s not his fault if people die on the stuff because they know what they're using and would just get it from someone else if he didn`t sell it to them.
Pennington stated that early morning of 11/28/2024 he and Stonecipher met Victim#1 near and traded 1-3 tenths of a gram of fentanyl to him for a Cricut machine. Pennington stated that Stonecipher told him a couple days later that something happened to Victim#1 after they had met with him, but Pennington and Stonecipher refused to talk to each other about what happened to Victim#1.
Pennington stated that the fentanyl that he and Stonecipher traded to Victim#1 did contain Xylazine. On 01/15/2025 This Detective contacted Stonecipher by phone and asked her to meet at the Sheriff Office to speak with me. Stonecipher agreed to do so, however never showed up.
The case was investigated by the Newton County Sheriff's Office.

It's a copy and pasted probable cause statement (official record). Comprehension not your strong point?
Victim 1 is what is used in the PC statement. Law Enforcement cannot put victim's names in PC.
It's the Police Report, not Inside Joplin, who uses the term, Victim #1.
