Lawsuit claim: Galena woman injured by falling shelving unit at Dollar Tree


In a lawsuit filed today in Jasper County Circuit Court, a Galena, Kansas woman claims she was injured by a falling shelving unit at Dollar Tree, 426 South Range Line Road, Joplin.

In her petition, Andrea Tunnell, who is represented by Springfield attorney William R. Robb of Aleshire, Robb & Rapp, says the incident occurred July 31, 2023 "when a metal shelving unit suddenly collapsed resulting in a laceration to her right leg and substantial bleeding, causing her to sustain serious injuries."







The petition alleges Dollar Tree "negligently permitted an unstable and imbalanced shelving unit on the premises which created an unreasonable risk of injury to invitees," and should have known that the shelves could tip over or collapse.

The shelving was an area frequented by customers, the lawsuit notes.

Dollar Tree's negligence caused Tunnel to suffer "serious physical injuries, including, but not limited to a laceration of the right lower leg, right Achilles tendon injury, Plantar Fasciitis and hip point injury, according to the petition, and says that she has continued pain in her lower leg and hip.

Tunnell is asking for fair and reasonable damages, plus interest and costs.
