Wrongful death lawsuit filed against Mercy Joplin


Mercy Joplin, three physicians and a nurse practitioner are defendants in a wrongful death lawsuit filed Thursday in Jasper County Circuit Court.

The lawsuit, which was filed by Julia Johannes, widow of Nick Johannes, alleges carelessness and negligence and asks for damages, costs, interest and a jury trial.








Listed as defendants, in addition to the hospital, are Eric Woolley, MD, Elizabeth Troilo, MD, Judith Russell, NP, and Olakanmi Deleawe, MD.

From the petition:

On April 2, 2025, Nick underwent a routine endoscopic ultrasound of his pancreas at Mercy Hospital in Springfield, Missouri. During the procedure, his gastric artery was perforated, which is a recognized complication, but this was not identified at the time. Nick was discharged later that day.

Upon discharge, Julia attempted to drive Nick home. On the way, they stopped at a bathroom where Nick lost consciousness and an ambulance was called. Nick was transported by ambulance to Mercy Joplin.

Dr. Woolley, the emergency room physician, evaluated Nick at Mercy Joplin. At the time, Dr. Woolley stated he was managing a high patient load and was overworked. He did not document or inquire about Nick's recent EUS. He did not perform a complete gastrointestinal evaluation, including but not limited to failing to order a CT scan or assess Nick's symptoms in the context of his recent invasive procedure. Dr. Woolley discharged Nick home the same day.







Over the following two days, Nick experienced increasing difficulty in breathing, speaking and walking. On April 5, 2025, he again lost consciousness and was rushed back to Mercy Joplin.

Upon arrival, Nick's hemoglobin levels had dropped and were dropping significantly. Julia explained that Nick had recently undergone an EUS, but NP Russell clapped in Julia's face and told her that the procedure and his medical history were irrelevant.

Nick's son-in-law urged NP Russell to order at CT scan for Nick, expressing concern about possible internal bleeding. Despite this request, NP Russell refused.

Instead, NP Russell ordered a rectal exam and a chest exam, both of which were inconclusive. The rectal exam showed no blood in the stool. Even after a blood transfusion, Nick's hemoglobin levels continued to decline.

NP Russell admitted Nick to a regular hospital room rather than to the ICU.

That same day, Dr. Troilo became Nick's admitting physician. Although Nick had no active atrial fibrillation, demonstrated a hemoglobin decline and had recently undergone an EUS, Dr Troilo initiated Eliquis, an anticoagulant medication.

Dr. Troilo did not order a cat scan.

On April 6, 2025, Dr. Deleawe discontinued the Eliquis. By that time, Nick was in severe respiratory distress and unable to form sentences due to shortness of breath. A nurse contacted Dr. Deleawe to report Nick's worsening condition.







In response, Dr. Deleawe ordered a chest x-ray, which showed an elevated right hemidiaphragm consistent with blood accumulating in Nick's abdominal cavity. Despite these findings, Dr. Deleawe did not physically examine Nick and did not order at CT scan.

Later on April 6, 2025, Nick was transferred to the ICU due to acute blood loss anemia. Another physician, Dr. Sunkara, ordered a CT scan to evaluate for intra-abdominal bleeding. In the early hours of April 7, 2025, Nick's CT scan revealed substantial abdominal bleeding.

Nick was then evaluated by surgeon Dr. Pace who determined embolization was too high-risk given the severity of bleeding at that point. He attempted to arrange a life-flight transfer to Mercy Springfield.







During this time, Nick repeatedly pleaded to be saved.

Nick died during transit on April 7, 2025, from gastric bleeding as a result of defendants' actions and failures, including the delay in treatment and diagnosis.

Plaintiff's attorneys are probably about to order rectal exams for the defendants, the results won't be inconclusive!

Russell is terrible and thinks she’s a physician. I’ve worked with her and have seen in her action, she’s is not as smart and capable as she thinks. Patients have the right to demand a new provider or transport to another facility.

This is absolutely negligence worthy of criminal charges. Mercy will pay out and it will all go away, unfortunately. The providers will keep on being crap providers and not follow protocols causing more damage to their patients.

I had and endoscopy done by Freemans Health System and I had been spitting up blood as well as having chest pains, she came in and said they could not do anything for me but give me a placebo for anxiety, I am still spitting up blood to this day and having chest pains with my left upper side swollen??? I know I was damaged due to negligence by Freemans and Mercy is treating me the same way here in Joplin I am so scared of dying but I am also scared of doctors, any help anybody? God Bless his family!

Folks you can’t trust all doctors, if your gut feeling tells you something isn't right you know your body they are “practicing medicine” don’t ever forget that…
No one will ever take your health as serious as you.
And never go to the doctor or hospital alone, more people watching them and listening is a good thing.
Always question what’s happening.

I’ve seen patients have food and water withheld from them and when I questioned why it was a mistake on their part, I’ve seen this happen at a minimum of 3 times all in Joplin Hospitals. I’m sure it happens everywhere.

Quick Question - Why do you think all these Medical Doctors and other Professionals, Lawyers, Dentist, Etc., are in Joplin and Southwest Missouri - because they are the cream of the crop - NOT! Professionals always hang their shingles out on the walls, but that doesn't say whether they graduated First in their Class or Last - If I was you and you could afford to travel outside of the Freeman and Mercy area possibly to a larger city or specialist, I would. Hate to say this, but there is a Truth to this. If you cannot afford or your insurance does not cover out of network, I would at least see if they have bad Google Reviews, Lawsuits on Case net, or have been Sanctioned from the State Medical or Legal Boards. I would look at that for any Professionals you use - Doctors, Lawyers, Dentists, Etc., Protect yourself and your Family. If you think this is all BS, how about a Prominent Local Dentist, who comes from a very Prominent Local Family - Dentist - Doctor John “Jay” Joseph, involved with Drugs, Hit and Run, and a Mountain of Legal Issues for years and years, but was able to keep his Dental License and Practice running - when it should have been revoked and closed years ago. This goes for several Medical Doctors, Dentists, and Lawyers, even Judges and Prosecutors in Southwest Missouri -

Question for 6:20 AM: Are the capitalization rules optional in med school?

(Asking for a friend who already knows how to capitalize and spell, they have really good grades at a good university and they are thinking about applying to med schools!)
