Diamond mayor faces assault charge after allegedly hitting constituent, pulling her hair


A January 14 arraignment is scheduled in Newton County Circuit Court for Diamond Mayor Brenda Schmitt, 54, who is charged with misdemeanor assault following a September 24 incident at City Hall in which she allegedly attacked a constituent who was using her cell phone to make a video.

According to the probable cause statement, Schmitt "physically placed her hands on (the alleged victim) in an attempt to knock her phone out of her hand.

"(She) was filming Ms. Schmitt after an altercation at the Diamond City Hall in Diamond, Missouri. During the events, Ms. Schmitt pulled (her) hair and hit her in an attempt to obtain (her) cell phone and prevent (her) from filming."

The accompanying video was posted on YouTube the same day by the alleged victim's son under the title "Mayor of the City of Diamond Missouri assaulting my disabled mother."

I would be mad if people were sticking a camera phone in my face or videoing me without my consent. People have no respect or boundaries.
I wish cell phones had no cameras.

The city council needs to begin impeachment proceedings. So much tax payer money has already went towards paying off lawsuits against this mayor and more will likely be used on this. Anyone who Googles her name will see the trail of damage she has caused our city. It's time to end the madness.

I, too, dislike cellphone cameras, but anyone choosing to serve as an elected office should accept that their actions are liable to be recorded and behave accordingly. If they can't then resign!

When you accept public office you accept the additional scrutiny and accountability that comes with holding public office.

If a person has a conviction in a court of law for something like this can they work for a school district? Keep in mind that in some parts way more than half the population is stuck in the '50s. THE 1850's!

The Diamond R-IV School District is committed to providing a safe environment for students to learn. As part of this effort, in accordance with this policy, the district will require criminal background checks of employees as well as certain volunteers and others working on district property. The Board directs the superintendent or designee to develop procedures and practices consistent with this policy.


District Notification

As a condition of continuing to work within the district, all employees and other persons required to submit to a criminal background check pursuant to this policy must notify the district if they are charged, convicted, plead guilty to or are otherwise found guilty of any misdemeanor or felony, regardless of the imposition of sentence. This notification must be made as soon as possible, but no later than five business days after the event, and is in addition to any reporting requirement established by law.

I doubt it! She should have never been rehired at the school after her last employment there. She also stole the money from project graduation 2011. The Joplin tornado canceled the event and she kept all the money.

I hope the school district has alreasy been notified. The Superintendent should look into this. And the School board should take action.

This school and school board have a long history of incompetence and controversy. I wouldn't count on them solving even the smallest issue. Town is trash...all the quality people moved over the last 10 years. School has went from nearly 1000 students to around 680. That should tell you all you need to know.

With understanding she was trying to get the victim to sign a waiver of liability. When the mayor started cursing and yelling she started used her phone to video.
