From the probable cause statement:
On October 21, 2025, at approximately 1450 hours, Carthage Police Officers responded to a reported motor vehicle crash at the intersection of Oak and McGregor Streets, in the City of Carthage, Jasper County, State of Missouri.
Upon arrival, officers observed a 2022 red GMC bearing Missouri EJ4T7P, involved in a collision with a 2015 black Dodge Ram bearing Missouri Temporary Tag 0086WQH, registered to Mark Mendez Hernandez. Officers also noted the presence of a third vehicle, an older silver pickup truck bearing Missouri 3CCL92, which had sustained heavy front-end collision damage and was able to drive a short distance from the intersection before stopping.
Multiple witnesses on scene provided statements regarding the events leading up to the crash. Witnesses stated that a Hispanic male later identified as the defendant, Mark Mendez Hernandez, was operating the Dodge Ram southbound on McGregor Street at a high rate of speed. The defendant failed to stop at the stop sign at Oak Street.
The red GMC was traveling eastbound on Oak Street, and the silver pickup truck was traveling northbound on McGregor Street. Witnesses reported that the Dodge Ram struck the driver’s side of the red GMC in a T-bone collision, forcing the GMC into the path of the silver pickup truck that was stationary at the stop sign.
Gale Lynn Wade, the driver of the GMC, was pronounced deceased at 1555 hours. Glenda Ruth Wade, the passenger in the GMC, was transported via Life Flight in critical condition. John Thomas Kimberlin, the driver of the silver pickup truck, sustained a laceration to his left arm.
Witnesses reported that the defendant exited his vehicle following the collision and fled the area. They maintained visual contact with him and assisted officers in locating him several blocks from the scene.
Upon contact, officers observed multiple indicators of impairment. Officers noted that the defendant had bloodshot, watery eyes, slurred speech, and an inability to stand without assistance. Officers also detected a strong odor of intoxicants emanating from the defendant.
Further investigation revealed that the defendant’s driving privileges were revoked. The defendant has seven (7) active revocations beginning in 2023. Additionally, the vehicle was uninsured, and the temporary registration on the Dodge Ram had expired for more than 30 days.

Persistent DWI offender. This time he changed lives forever. No insurance, which leads one to believe there’s no use suing for damages b/c there would be nothing to gain. The victims are saddled with financial, psychological/mental and physical devastation at the hands of this derelict. Hope he’s sent away for a long time, but it seems that is highly doubtful. Prayers for the victims and their families for healing.
Thanks for keeping us safe Missouri Department of Corrections! Your hug-a-thug mentality and supervision guidelines caused this death. Lock up criminals and make then do real time in prison. Enough with the softness shown to these criminals!
Look up who the judges and prosecutors are, the blood is on their pathetic hands…
Because of these hug-a-thug judges and prosecutors, my cousin is now without her husband of 50 years. WHAT TRASH THEY ARE!!!
We must Berate and Reprimand all these Worthless Low-Life - Judges, Prosecuting Attorneys, and/or Jurors that allowed this Persistent Offender, and other Persistent Offenders back on the Streets - To Finally Kill Innocent Individuals - Why would you allow this to happen - He has over 14-Legal Issues on Case Net - - What does it take for you Judges, Prosecuting Attorneys an/or Jurors to realize before it is too late? You are Voted, Appointed, or Bound to Protect the People in our Society - Yet, you feel that you need to give these Criminals like, Mark Anthony Mendez-Hernandez, additional opportunities to Kill and Destroy the lives of Innocent Individuals - without even a second thought - You want to Cut Deals, Give Slaps on the Wrist - with these devils, because you don't want to do your jobs and Prosecute them - - YOU ARE SCUM - WORTHLESS POS's - YOU ARE RESPONSIBLE - FOR ALLOWING THIS PERSON TO KILL INNOCENT PEOPLE - STOP BEING SOFT ON CRIMINALS - DO YOUR JOB - DO YOU SEE WHAT HAPPENS - WHEN YOU DON"T DO YOUR JOBS - INNOCENT PEOPLE DIE....................
8:38 Do you feel better after your rant? I believe everyone is in agreement that something prior to this needed to have been done to help prevent this horrible accident from happening. If you want this to change, start writing letters to your State Congressman, Representative and Governor to change the current laws. Start attending all campaign rallies and asking hard questions, not just the ones that you prefer politically. Start doing your research on Judicial and Sheriff candidates and again not just the ones that align with your political views. Research through multiple sources about every candidate, not just the ones of your preferred party. Voting should be taken more seriously than just voting on the candidate with an R or D or I beside their name. I believe we all want a candidate in office who will do the best job for all of us, as a member of a free society. The things I’ve mentioned may not make a difference but it seems that doing these items may benefit more than just capitalizing your frustrations as a commentator and may make a difference in the future.
5:21PM, Yes I do feel better after voicing my opinions and concerns. First you need to not look at the police, sheriffs, highway patrol, etc., they are doing their jobs by arresting plenty of criminals. What happens after that is up to the Judges, Prosecuting Attorneys, and even the Jurors - who are swayed by feeling liberally sorry for the criminals and not the victims' - cutting deals with their defendant's attorneys, because it is easier than doing their elected or appointed duties. These Judges and Prosecuting Attorneys get a lot of their election money from fellow Law Firms and Attorneys - the same ones defending these slimy criminals - Plus you seem to forget the amount of discretion in the laws that these Judges and Prosecuting Attorneys have - they are not following the letter of the law, but the letter of the deal for their Legal Friends and Buddies. No matter what, we need to comment and track how our local elected and appointed Judges and Prosecuting Attorneys are representing their communities and how they are not committing to what is the right things to do - How do we do this through sharing information on Blogs - Like This - What the Hell is writing our Congressman, Representatives, Senators, or the Governor going to do - NOTHING, this has to be done - Locally - Through Your Vote - and Discussion Boards, Forums, Blogs or Organizations - (Mother's Against Drunk Drivers, Father's Against Drunk Drivers, Student's Against Drunk Drivers - Etc., Etc., Etc., ) - - DOES THAT MAKE SENSE - - -
Until we take the Howard Beale Approach - Nothing Will Change: I want you to go to the window, open it, stick your head out and yell: "I'm as mad as hell, and I'm not going to take this anymore."
