Supreme Court to legislators on school transfers: It's your problem

Any hopes the legislature had that the Missouri Supreme Court would help them on the issue of transfer students were dashed today when the court issued an opinion upholding the law allowing students to transfer from failing schools to other schools with the failing school district picking up the tab.

The lawsuit, filed by the Blue Springs, Raytown, Independence, Lee's Summit, and North Kansas City school districts, argued that the requirement was an unfunded mandate that violated the Hancock Amendment.

The court disagreed, saying it was not requiring the receiving school districts to provide extra services, but simply redistributing where the students were receiving those services.

The court followed the same reasoning it used earlier in a case involving St. Louis area school districts.

The issue is expected to be one of the top educational issues to come before the legislature in 2014.
